Ordinance No. 80-43 CITY OF TIGARD, OREGON ORDINANCE NO. 80- #,- - AN ORDINANCE ADOPTING FINDINGS WITH RESPECT TO AN APPLICATION FOR AN AMENDMENT TO THE 1970 ZONING MAP OF THE CITY OF TIGARD AND FIXING AN EFFECTIVE DATE. PLANNING DEPARTMENT REFERENCE INFORMATION: Tax Map lSl 35B, Tax Lots 700 & 800, Project Address fronts approximately 2201 on the east side of Greenburg Road, 250' north of North Dakota Street, File Numbers ZC 7-80/CU 5-80, Present Zoning Designation Washington County_ RU-4, Zone changed to City of Tigard A-12 "Multifamily, Applicant Larry Leahy Drinkwater Engineering T1E CITY OF TIGARD ORDAINS AS FOLLOWS: SECTION 1: Finding that the lands hereinafter described are now classified as Washington County RU-4, and further findings that pursuant to procedures, the abovestated application for a zoning map amendment was presented at a public hearing and thereafter the Planning Commission filed its report ( with the City Recorder, a copy hereto attached and by reference made a part of. `1. The Council adopts the following substantive findings: A. That this application is in conformance with the A-12 "Multifamil•.r" designation on the NPO #2 Plan which is a portion of the adopted Tigard Comprehensive Plan, and B. That the proposed zoning is compatible with the surrounding neighborhood as determined by the Tigard Planning Commission. SECTION 2: Therefore, pursuant to the requirements of Chapter 18.88 of the Tigard Municipal Code, this request for an amendment to the Zone Map of the City of Tigard is hereby approved subject to provisions of Chapter 18.20 of the Tigard Municipal Code as embodied in adopted Exhibits "A", "B", and "C" attachad and made a part of this Ordinance. Exhibit "A": - Legal Description, Exhibit "B": - Tax Map, Exhibit "C": --Staff Report And further subject to the following conditions: 1. A]-1 development on either parcel shall be subject to Site Design Review. 2. If these properties are to develop together, it may be necessary to combine the lots to satisfy the Building Department requirements prior to issuance of a Building Permit. Grading plans and construction plans on all public right-of-ways shall be submitted and approved by the Public Works Director prior to commencement of work. 4. Public water service and sanitary service shall be installed to this site prior to the issuance of a Building Permit. 5. All existing or proposed utilities shall be placed underground. Street lighting installations shall be approved by the Public Works Director. 6. No Building Permit shall be issued until the expiration of the twenty (20) day appeal period from the date of approval. 7. Improvements may be bonded prior to issuance of Building Permits. 8. That street improvements be constructed to the approval of the Public Works Director prior to the recording of the final plat or issuance of a Building Permit. g. That development will be subject to full review and approval by the Public Works Director for site drainage. SECTION 3: This ordinance shall be effective immediately after its passage (l by the Council and approval of the Mayor. REQUEST: For a Zone Change from Washington County RU-4 to City of Tigard A-12 "Multifamily" and a Conditional Use request for professional offices in the A-12 Zone. (Section 18.24.020 of the Tigard Municipal Code) This zone is specified on the Tigard Comprehensive Plan. j PREVIOUS ACTION: Property recently annexed to the City, (Boundary Commission #1534. Tigard has not formally approved this annexation by ordinance. 1. FINDINGS OF FACT: 1. This zone change is in conformance with the Tigard Comprehensive Plan. 2. Conditional Use for professional offices is appropriate under Section 18.24.020 of the Code. II. CONCLUSIONARY FINDINGS: 1. Greenburg Road is in substandard condition. 2. The proposed use of this land is compatible with surrounding development. 3. The City does not now control the Greenburg right-of-way fronting these properties. All work in the public right-of-way will be through Washington County and Tigard°s Public Works Director. Final approval of annexation was granted on February 7, 1980 for annexation to take place on April 1 rather thar� on March 9 which was the ninetieth day after the hearing. This postponement was granted as a result of one of the petitioner's request to withdraw submitted at the first hearing. As a result of this request the Boundary Commis- sion set the date forward to April 1 to permit the comple- tion of construction while still within the Washington County jurisdiction. The requested zone change is a resu3t of this annex- ation since the affected properties brought with them the �. appropriate Washington County zoning: RU-4 (Urban Low Density) for Tax Lot 700 and RU-20 (Urban 1-4edium/High Density) for am I Tax Lot 800. The City of Tigard Comprehensive Plan has desig- nated the area as A-12, Urban Medium Density. The requested zone change will, then, eliminate the Baker conflict on Tax a.r Lot 700 and resolve the density differences between the county RU-20 zone and the Tigard A-12 zone.
