AN ORDINANCE ADOPTING FINDINGS WITH RESPECT TO AN APPLICATION FOR AN AMENDMENT
TO THE 1970 ZONING MAP OF THE CITY OF TIGARD AND FIXING AN EFFECTIVE DATE.

'PHE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: Finding that the lands hereinafter described are now classified as
C-3 "General Commercial", and further findings that pursuant to
procedures, the abovestated application for a zoning map amendment was presented
at a public hearing held by the Tigard Planning Commission on March 18, 1980. All
interested persons were afforded an opportunity to be heard at this public
hearing and thereafter the Planning Commission filed its report with the City
Recorder, a copy hereto attached and by reference made a part of. The Council
adopts the following substantive findings:
A. That this application is in conformance with the land use
designation on the NPO #4 Plan and is an approved Conditional
use in the C-5 Zone which is a portion of the adopted Tigard
Comprehensive Plan, and
B. T'iat the proposed zoning is compatible with the surrounding
neighborhood as determined by the Tigard Planning Commission.
Section 2: Therefore, pursuant to the requirements of Chapter 18.88 of the
Tigard Municipal Code, this request for an amendment to the Zone
Map of the City of Tigard is hereby approved subject to provisions of Chapter
18.20 of the Tigard Municipal Code as embodied in adopted Exhibits "A", "B",
and "C" attached and made a part of this Ordinance.

And further subject to the following conditions:
1. All street improvements made to Villa Ridge Road shall be approved by the
Oregon Depa rtuent of Transportation, Bill Geibel, and the Tigard Public
Works Director.

2. This project must receive Site Design Review approval by Staff prior to
issuance of Building Permits.
3. Phase I shall be the remodeling of the existing area abutting Villa Ridge
Road. Occupancy permits may be issued for this Phase I area prior to the
completion of Phase II which is the new construction of the warehouses.
4. For Phase II, the applicant receive written approval from the Building
Department and Public Works Department confining that the grading plans,
site drainage, and soils conditions are appropriate for construction prior
to issuance of Building Permits.
5. No changes will be made to approved plans or specifications unless formal
application is made to the appropriate City Department and changes are
approved by that Department. Application for changes will be made in
writing and shall include applicable drawings.
6. All existing or proposed utilities shall be placed underground. Street
lighting installations shall be approved by the Public Works Director.
7. No Building Permit shall be issued until the expiration of the twenty
(20) day appeal period from the date of approval.
8. Improvements may be bonded prior to issuance of Building Permits.
Section 3: This Ordinance shall be effective immediately after its passage by
the Council and approval of the Mayor.

4. Page 3 addresses the drainage and grading plan on the southern portion
of the site. This is not a detailed plan and, therefore, further technical
engineering design will need to be submitted to the Public Works Director
for approval prior to the issuance of Building Permits.
5. The fifth page of the Plan shows that three of the five (5) warehouse buildings
will be two stories high. The Plan also indicates that the parking spaces
and landscape areas exceed Code requirements. "
6. Northwest Testing has been hired by the applicant to evaluate the soils
condition of the site as requested at the January 22nd meeting. The report
addresses the need to stabilize the warehouse foundations in certain
areas. Pages 2 and 3 of the report describes the existing fill material
and suggests construction methods to support building foundations.
7. Mr. Currie, the Public Works Director, has reviewed this report and finds
that it is accurate, and no substantial adverse condition exists if the
applicant constructs the building pads as indicated in this report.
He also requests that a condition be placed on the approval of this application
that the Building Department Director inspect the soils rehabilitation and
compaction work prior to issuance of Building Permits.
8. Access to and from the site will be off Villa Ridge (a frontage road that
parallels Pacific Highway). The site is just south of the northern
ingress/egress to Villa Ridge Road off of Pacific Highway. This lessens
E the direct impact on Pacific Highway. Villa Ridge is the jurisdiction
of the State Highway Department. _
9. Sewer and water are on the site and have ample capacity for the proposed use_
II. CONCLUSIONARY FINDINGS:
I. The proposed use is compatible and the applicant has pointed out (at
the January 22nd hearing) and Staff agrees that the subject property
location lends itself to this type of operation and it will not adversely
affect the traffic circulation or the .surrounding properties.
2. Villa Ridge Drive requires some paving and sidewalk improvements.

PREVIOUS
ACTION: On January 22, 1979, the Planning Commission approved a Conditional
Use request for vehicle rentals and storage on the subject site with
the condition that the applicant return with a detailed soils
test and pians showing how they will handle the sensitive lands
area®together with other staff recommended conditions (See Exhibit
"A") e The applicant has been required to submit a General Plan and
Program application for this second hearing by the Staff. This
requirement is in keeping with Section 18.56.015 of the Tigard
Municipal Code which requires any alteration of sensitive lands
to be designated a Planned Development, The applicant has submitted E.

I, FINDINGS OF FACT:
1. Exhibit "8" is the Staff Report from the CondLtional Use request application
(dated January 8, 1980) which will serve as the Preliminary Plan Review,
This report describes the existing zoning and land use designations for
your review,. (See Exhibit "C", Applicant's Narrative)
2. The applicant has revised the plan from seven (7) warehouse storage facilities
to five (5) located on the back half of the subject site, (See attached i
S page site plan) .
3. As the perspective plan (1st page) indicates, the existing brick building �!

will remain and the older workshop will be removed. The rental trucks will
be parked near the entrance to Villa Ridge for advertisement purposes.

3. The proposed use is in compliance with the land use designation of the
Comprehensive Plan and is an approved Conditional Use in the C:-5 Zone.
4. Building on the sensitive lands areas is possible if proper procedure is
followed. Therefore, the City Staff must work closely with the applicant to
insure that this is accomplished.
III. STAFF RECOMMENDATION:
Staff recommends approval of the General Plan and Program with the following
condi tions:
