ORDINANCE No. 80 - 162
AN ORDINANCE RATIFYING ANNEXATION OF LANDS BY BOUNDARY COMMISSION, ORDER NO. �
RECORDING AN EFFECTIVE: DATE AND DECLARING AN EMERGENCY. WALKER ANNEXATION
WHEREAS, the Boundary Commission established pursuant to Chapter 494 Oregon
Laws of 1969 for the Portland Metropolitan Area, by its final order dated12/IUD—
approved the hereinafter described change in the boundaries of the City of Tigard,
and a copy of said final order has been filed with the City Recorder.
NOW, THEREFORE,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: That the final order of the Boundary Commission adopted on the 12th
day of December, 1979 , a copy whereof is hereto attached and by this
reference made a part hereof, be, and the same is, hereby ratified, confirmed and
adopted by reference to the same legal force and effect as if set forth herein in full.
Section 2: That the boundaries of the City of Tigard be, and they are hereby changed
to include the lands as described in the within order of the Boundary
Commission, and the corporate limits of the City of Tigard are hereby changed in
conformity therewith.
Section 3: That the Recorder of the City of Tigard be, and she is hereby, directed
to forthwith file a copy of this ordinance, including a copy of said Order,
in the following offices:
(a) Secretary of State
(b) Department of Revenue and Taxation, Washington County
(c) Department of Records and Elections, Washington County
(d) Department of Public Worcs, Attention: Surveyor, Washington County
Section 4: That the City Planning Commission be, and it is hereby authorized and
directed to conduct such proceedings as may be necessary to conform the
authorized zoning and land use of the described premises to the requirements of the
City's Zoning Map and Code.
Section 5: Inasmuch as it is necessary for the peace, health and safety of the
people of the City of Tigard that the foregoing change in the boundaries
of the City become a permanent part of the City's records, an emergency is hereby
declared to exist, and this ordinance shall be effective upon its passage by the-
Council, and approval by the Mayor.

FINAL ORDER
RE: BOUNDARY CHANGE PROPOSAL NO. 1518 - Annexation of territory to
the City of Tigard.
Proceedings on Proposal No. 1518 commenced upon receipt by the Boundary
Commission of a resolution and property owner consents from the City
of Tigard on November 7, 1979 requesting that certain property be an-
nexed to the city. The resolution and property owner consents meet
the requirements for initiating a proposal set forth in Chapter 880
Oregon Laws 1979.
Upon receipt of the petition the Boundary Commission published and
posted notice of the public hearing in accordance with ORS 199.463
and conducted a public hearing on the proposal on December 13, 1979.
The Commission also caused a study to be made on this proposal which
considered economic, demographic and sociological trends and projec-
tions and physical development of the land.
FINDINGS
On the basis of the public hearing and the study the Boundary Com-
mission found that :
1. The territory to be annexed is contiguous to the city and contains
12. 45 acres , 1 sin le family residence , a population of 3 and an
assessed value of 83,200 .
2. The property owner requests annexation to obtain urban services '
to facilitate development. 1
3. The territory is identified as Urban Intermediate on the Washington
County Framework Plan; but the joint city/county Tigard Urban-
ization Study proposes to designate it Urban. Current county zoning
is RS-1 (Suburban Residential) which allows single family dwellings
at a variety of densities depending on availability of public
services; with public sewer and water, 20 ,000 sq. ft. lots are
permitted in this zone.

4. Sewer service will be available from the North Bull Mountain Trunk
which terminates at 130th at the east boundary of the territory.
5. The territory can be served by the Tigard Water District upon an.-
nexation to the district. Service will be from a 2" main located.
at the northeast corner of the parcel. The district has adequate
source and storage capacity to serve the territory at densities
provided in the city' s comprehensive plan,
6. Fire protection will continue to beprovidedby Washington County
RFPD #1.

7. Police , street maintenance, planning, etc. , will be provided by
the City of Tigard upon annexation.
8. The annexation is consistent with applicable city, county, regional
plans , and with applicable LCDC Goals .
REASONS FOR DECISIONS
On the basis of the findings the Commission determined that:
1. The owner requests annexation to obtain city services to facilitate
residential development on the site.
2. The proposal is consistent with the City of Tigard, county, and
regional planning for the area as well as with LCDC Goals, and the
proposal meet the requirements of the LCDC Annexation Rule
3. The Tigard Water District has the ability to supply an adequate
quantity of water to the area upon annexation to the water district.
4. A full range of urban services is available to the terrtory.
ORDER
On the basis of the findings and reasons listed above, the Boundary
Commission approved BOUNDARY CHANGE PROPOSAL NO. 1518 on December 13,
1979.
NOW 'THEREFORE IT IS ORDERED THAT the territory described in Appendix
"A" and depicted on the attached map, be annexed to the City of Tigard
as of this date

The following described property situated in Section 33 Township, South, Range 1
West of the Willamette Base and Meridian, Washington County Oregon to wit.
Beginning at a point 792 feet west of the center
of said Section 33;
thence due East 547.54 feet to a peint on existing
city limit line, said paint being on the
east line of the west one-half of the
east one-half of. said Section 33;.
thence Southerly along said east line a distance of
990 feet;
thence Westerly parallel with the north line of the
southeast quarter of said Section 33 a
