AN ORDINANCE AMENDING CHAPTER 7.36 OF THE TIGARD MUNICIPAL CODE RELATING
TO SALE TO, PURCHASE OF, OR POSSESSION OF LIQUOR BY PERSONS UNDER 21
It appearing to the City Council of the City of Tigard that
recent changes in Oregon laws relating to the age of majority create
potential confusion as to the applicability of certain laws and ordin-
ances having to do with sale to, purchase by, or possession of liquor
by persons under 21, and
It being the intent of the City Council to bring the ordinances
of the City as nearly as practicable into conformance with state statutes
dealing with the same subject,
NOW, THEREFORE, Chapter 7.36 of the Tigard Municipal Code is
amended to read as follows:

7.36.00. Purchase or possession of liquor by person
under 21 years of age. (1) No person under the age
of 21 years shall attempt to purchase, purchase, or
acquire alcoholic liquor. Except when such minor is
in a private residence accompanied by his parent or
guardian and with such parent's or guardian's consent,
no person under the age of 21 years shall have in his
possession alcoholic liquor.
(2) For the purposes of this section, possession of
alcoholic liquor includes the acceptance or consume-
tion of a bottle of such liquor, or any portion thereof
or a drink of such liquor. However, this section does
not prohibit the acceptance or consumption by any person
of sacramental wine as part of a religious rite or
service.
(3) A person under the age of 21 years who attempts to
purchase, purchases, or acquires alcoholic liquor., or
who illegally has in his possession alcoholic liquor,
commits a violation punishable by a fine of not more
than $100.
This ordinance shall become effective upon the 31st day
following its passage and signature by the mayor.
