ORDINANCE NO. 80- 1o
AN ORDINANCE AMENDING COMPREHENSIVE PLAN MAP (NEIGHBORHOOD PLANNING ORGANIZATION
NUMBER ONE) WITH RESPECT TO THE APPROPRIATE LAND USES TO BE LOCATED ON THE NORTHEAST
CORNER OF SW GARRETT STREET AND PACIFIC HIGHWAY (WASH. CO. TAX MAP 2S1 2CB, TAX
LOTS 2400 and 2500) AND SPECIFYING THAT THE C-3, GENERAL COMMERCIAL ZONE, BE
USED TO IMPLEMENT THE PLAN'S POLICIES AND OBJECTIVES; AND FIXING AN EFFECTIVE DATE.
THF CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: The City Council finds that it is necessary, expedient and for the
best interests of the people of the City of Tigard that the Plan
Map of Neighborhood Planning Organization Plan Number One be revised so as to
attain the purposes and objectives of ORS Chapter 197 and ORS Chapter 227 insofar
as applicable with respect to the Ash Avenue-Downtown Planning area.
Section 2: The Council further finds that amendment of the Neighborhood Plan
Number One Map Designation for Tax Lots 2400 and 2500 (Tax Map
2S1 2CB)as retail commercial is appropriate due to the fact that the highest
and best use of the property compliments the existing retail use to the east
and efficient traffic movement can be obtained due to the location of the
properties to the intersection of S.W. Pacific Highway and S.W. Garrett Street.
Section 3: The City Council further finds that after due and legal notice a public
hearing was held at the lecture room of the Fowler Junior High
School, Tigard, Oregon, on Tuesday, January 22, 1980 p.m. by the Planning
Commission whereat an oral presentation and pictorial display of facts was
given by the Planning Staff and all interested persons were afforded an
opportunity to be heard with respect thereto and to comment thereon.
Section 4: The Council further finds that Neighborhood Planning Organization
Number One, at a meeting of January 16, 1980 was presented and gave
due consideration to the revised map change of Neighborhood Planning Organization
Plan Number One with respect to the Ash Avenue-Downtown Area as pertaining to
the appropriate land uses to be located on that portion of Garrett and Pacific
Highway Tax Lots 2400 and 2500 traversing the neighborhood and specifying that
the C-3 General Commercial Zone be used to implement the Plan's policies and
objectives.
Section 5: That Ordinance No. 74-25, adopted by the Council on May 20, 1974,
be and the same is hereby amended to conform to the foregoing and
to the extent of any inconsistency between this Ordinance and said prior
Ordinance No. 74-25, the provisions hereof shall supersede Ordinance No. 74-25.
Section 6: This ordinance shall be effective on and after the 31st day after
its passage by the Council and approval of the mayor.
