AN ORDINANCE AMENDING CERTAIN SECTIONS OF THE TIGARD MUNICIPAL CODE RELATED
TO HOME OCCUPATIONS.
WHEREAS, it has been found that certain circumstances require lengthy and involved
processes; and
WHEREAS, it is the intent of the City Council to establish a smooth application
procedure for certain planning matters; and
WHEREAS, it is hereby agreed that this intent is served by the passage of this
ordinance;
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
SECTION 1: Section 18.20.010 PERMITTED USES Subsection (3) Home Occupations
only as strictly defined in Section 18.08.250 is deleted.
SECTION 2: Section 18.20.020 CONDITIONAL USES, Subsection (9) Conditional
Homes Uses is deleted, and Subsections 10 through 16 are renumbered
in sequential order.
SECTION 3: The following new section is created: 18.20.021 HOME OCCUPATIONS.
Certain Home Occupational Uses which do not strictly conform to
the criteria set forth for home occupations as defined in Section 18.08.250 may
be approved by the Planning Director following procedures hereby established.
(a) An application for a Home occupation Permit shall be filed with the
Planning Director.
(b) A review of the request shall be made and appropriate conditions
may be added to protect the applicant and surrounding property owners
from potential conflict.
(c) The Planning Director may approve the permit with conditions or deny
the permit. An acknowledgement statement indicating that any and
all conditions are understood and accepted must be signed by the
applicant, and returned to the Planning Director within ten (10) days.
(d) A business license must be obtained by the applicant for the home
occupation if approved.
(e) It is the intent of this prov"ioa to provide the means of request
for the consideration of home occupation type uses when special
circumstances are present which the applicant feels deserve this
consideration. It is the intent of this title that any commercial
or industrial operations which would ordinarily be conducted in a
commercial or industrial district continue to be conducted in such
district and not at home.
(f) An appeal of any decision of the Planning Director in regards to
Home Occupation Permits may be made to the Planning Commission within
fourteen (14) days following final action. A written notice of appeal
shall be filed with the City Recorder.
