ORDINANCE No. 79
AN ORDINANCE RATIFYING, CONFIRMING AND RECORDING CHANGE IN THE BOUNDARIES OF THE
CITY OF TIGARD BY THE BOUNDARY COMMISSION, ORDER No. 1425 , INVOLVING LANDS OF
JUNGE ANNEXATION, SECTION 35, T014NSHIP 1 SOUTH, RANGE 1 WEST, WILLAMETTE MERIDIAN,
WASHINGTON COUNTY, OREGON, RECORDING EFFECTIVE DATE AND DECLARING AN EMERGENCY.
WHEREAS, the Boundary Commission established pursuant to Chapter 494
Oregon Laws of 1969 for the Portland Metropolitan Area, by its final order
dated June 7, 1979 approved the hereinafter described change in
the boundaries of the City of Tigard, and a copy of said final order has been
filed with the City Recorder.
NOW, THEREFORE,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: That the final order of the Boundary Commission adopted on the
7th day of June, 1979 _. a copv whereof is hereto
attached and by this reference made a part hereof, be, and the same is, hereby
ratified, confirmed and adopted by reference to the same legal force and effect
as if set forth herein in full.
Section 2: That the boundaries of the City of Tigard be, and they are hereby,
changed to include the lands as described in the within order of the
Boundary Commission, and the corporate limits of the City of Tigard are hereby
changed in conformity therewith.
Section 3: That the Recorder of the City of Tigard be, and she is hereby,
directed to forthwith file a copy of this ordinance, including a
copy of said Order, in the following offices:
(a) Secretary of State
(b) Department of Revenue and Taxation, Washington County
(c) Department of Records and Elections, Washington County
(d) Department of Public Works, Attention: Surveyor,
Washington County
Section 4: That the City Planning Commission be, and it is hereby, authorized
and directed to conduct such proceedings as may be necessary to
conform the authorized zoning and :Land use of the described premises to the
requirements of the City's 2oiiag Map and Code.
Section 55: Inasmuch as it is necessary for the peace, health and safety of the
people of the City of Tigard that the foregoing change in the
boundaries of the City become a permanent part of the City's records, an emergency
4s hereby declared to exist, and this ordinance shall be effective upon its passage
by the Council', and approval by the Mayor.

FINAL ORDER
RE: BOUNDARY CHANGE PROPOSAL NO. 1425 - Annexation of territory to
the City of Tigard.
Proceedings on Proposal No. 1425 commenced upon receipt by the Boundary
Commission of a petition from property owners on April 27 , 1979
requesting that certain property be annexed to the city. The petition
meets the requirements for initiating a proposal set forth in ORS 222. 170
and paragraph (a) Section (4) of ORS 199.490.
Upon receipt of the petition, the Boundary Commission published and
posted notice of the public hearing in accordance with ORS 199.463
and conducted a public hearing on the proposal on June 7 , 1979. The
Commission also caused a study to be made on this proposal which
considered economic, demographic and sociological trends and projections
and physical development of the land.
FINDINGS
On the basis of the public hearing and the study, the Boundary
Commission found that:
1. The territory to be annexed is contiguous to the city and contains
.49 acres, is vacant, and is evaluated at $29 ,700.
2. The petitioner desires annexation to obtain city services to
facilitate construction of a duplex on the site.
3. The area is Urban on the CRAG/MSD Framework Element and within the
Interim Immediate Growth Boundary.
4. The territory is Urban on the Washington County Framework Plan.
Current county zoning is RU-4 permitting 7,000 sq. ft. minimum
lot sizes on a potential for 2 units on the site.
S. The proposal is in conformance with applicable LCDC goals.
6. The territory is within the Metzger Water District which serves this
area of the city. Water is available from a main fronting the
property in SW 95th Ave.
7. A City of Tigard sewer line is available to serve the site from a
main located in SW 95th Ave. fronting the property.
8 The territory is within Washington County RFPD #1 which also serves
this part of the city.
REASONS FOR DECISION
On the basis of the findings, the Commission determined that:

1. The petitioners desire sewer service from the city to facilitate
development of a duplex.
2. The proposal conforms with city, county, and regional land use
plans and with applicable LCDC goals.
3. Upon annexation a full range of urban services will be available.
ORDER
On the basis of the findings and reasons lsited above, the Boundary
Commission approved BOUNDARY CHANGE PROPOSAL NO. 1425 on June 7, 1979 .
NOW THEREFORE IT IS ORDERED THAT the territory described in Appendix
"A." and depicted on the attached map, be annexed to the City of
Tigard as of this date.

Annexation
CITY OF TIGARD
A parcel of land located in the Northwest quarter of Section 35, Township
1 South, Range 1 West, Willamette Meridian, Washington County, Oregon, being
more particularly described as follows:
Beginning at the intersection of the centerline of S.W. worth Dakota
street and the centerline of S.W. 95th Avenue (County Road No. 1018); thence
North 000 10' West, along the centerline of said S.W. 95th Avenue, a distance
of 800 feet, to a point, said point being the true point of beginning, thence
14orth 890 53' 6-lest, a distance of 220 feet; thence Southwesterly, a distance
of 32 feet, to the Southeast boundary line of the abandoned Oregon Electric
Railroad right-of-way, thence North 520 18' East, along said boundary, a dis-
tance of 320 feet, more or less, to the centerline of said S.W. 95th Avenue;
thence South 000 01' East, along said centerline, a distance of 193 feet, more
or less, to a point on said centerline, said point being the true point of
beginning.
