AN ORDINANCE RATIFYING, CONFIRMING AND RECORDING CHANGE IN THE BOUNDARIES OF THE
CITY OF TIGARD BY THE BOUNDARY COP[MISSION, ORDER No. 1426 , INVOLVING LANDS OF
CHRISTEN ANNEXATION, SECTION 1. TOWNSHIP 2 SOUTH, rkNGE 1 WEST, WILLAN>ETTE MERIDIAN,
WASHINGTON COUNTY, OREGON, RECORDING EFFECTIVE DATE AND DELLARINC; AN EMERGENCY.
WHEREAS, the Boundary Commission established pursuant to Chapter 494
Oregon Laws of 1969 for the Portland Metropolitan Area, by its final order
dated June 7. 1979 approved the hereinafter described change in
the boundaries of the CityofTigard, and a copy of said final order has been
filed with the City Recorder.

THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: That the final order of the Boundary Commission adopted on the
7 day of June, 1979 a coD,v whereof is hvraro
attached and by th..s reference made a part hereof, be, and the same is, hereby
ratified, confirmed and adopted by reference to the same legal force and effect
as if set forth herein in full.
Section 2: That the boundaries of the City of Tigard be, and they are hereby,
�_ changed to include the lands as described in the within order of the
Boundary Commission, and the corporate limits of the City of Tigard are hereby
changed in conformity therewith.
Section 3: That the Recorder of the City of Tigard be, and she is hereby,
directed to forthwith file a copy of this ordinance, including a
copy of said Order, in the following offices:
(a) Secretary of State
(b) Depart-nent of Revenue and Taxation, Washington County
(c) Department of Records and Elections, Washington County
(d) Department of Public Works, Attention: Surveyor,
Washington County
Section 4: That the City Planning Commission be, and it is hereby, authorized
and directed to conduct such proceedings as may be necessary to
conform the authorized zoning and land use of the described premises to the
requirements of the City's Zoning Map and Code.
Section 3: Inasmuch as it is necessary for the peace, health and safety of the
people of the City of Tigard that the foregoing change in the
boundaries of the City become a permanent part of the City's records, an emergency
is hereby declared to exist, and this ordinance shall be effective upon its passage
by the Council, and approval by the Mayor.

FINAL ORDER
RE: BOUNDARY CHANGE PROPOSAL N0, 1426 Annexation of territory to
the City of Tigard.
Proceedings on Proposal No. 1426 commenced ,upon receipt by zhe
Boundary Commission of a petition from property owners on April 27,
1979 requesting that certain property be annexed to the city. The
petition meets the requirements for initiating a proposal set forth
in ORS 222.170 and paragraph (a) Section (4) of ORS 199.490.
Upon receipt of the petition, the Boundary Commission published and
posted notice of the public hearing'in accordance with ORS 499.463
and conducted a public hearing on the proposal on June 7, 1979, The
Commission also caused a study to be made on this proposal which
considered economic, demographic and sociological trends and projections
and physical development of the land.
FINDINGS
On the basis of the public hearing and the study, the Boundary
Commission found that:
1. The territory to be annexed is contiguous to the city and contains
9.93 acres, 1 single family residence, an estimated population
of 2, and is evaluated atS9 0
$ ,1 0.
2. The property owners desire annexation to obtain city services to
facilitate industrial development of the site. A large industrial
project is proposed in this area. This parcel is the first of
several properties anticipated to annex for this proposed
development.
3. The territory is designated Urban on the regional plan and is
within the Interim Immediate Growth Boundary.
4. The territory is designated Urban on the county framework plan. �
The northern portion of this lot is zoned RU-4 and the ma'orit
is zoned MA-1, J Y
5. The territory is within the area known as the Tigard Triangle
and is designated Industrial Park on the adopted IPO Plan #4.
It is within sub-area #3 on the city's adopted annexation plan which
supports annexation of this area.
6." The proposal conforms with applicable LCDC Goals.
7. The area is within the boundary of the 'Metzger water District
which has- anticipated. 'the industrial development in this area
and has 12-inch mains in Pacific Hwy. , SW Duvall and SW 72nd.

8. Sewer service within this area is presently provided by pumping
northerly. Development of the industrial park will provide
gravity service to the Fanno Creek Interceptor as part of the
development.
9. The territory is-within the boundary of Washington County RFPD
#1 which provides protection within the city as well. Fire flows
in the vicinity are adequate to protect industrial development.
REASONS FOR DECISION
On the basis of the findings , the Commission determined that :
1 . The proposal is an incremental step toward the annexation of the
entire area surrounded by Tigard on three sides. Service efficiency
and economy will be improved by annexation of the area.
2. The proposal conforms with city, county and regional planning
for the area and with applicable LCDC Goals.
3. A full range of urban services will be available upon annexation.

ORDER
On the basis of the findings and reasons listed above, the Boundary
Commission approved BOUNDARY CHANGE PROPOSAL NO. 1426 on June 7, 1979.
NOW THEREFORE IT IS ORDERED THAT the territory described in Appendix
"A" and depicted on the attached map, be annexed to the City of
Tigard as of this date.

Beginning at the initial point of PALMER ACRES, a sub-
division of record in said county; thence N 010 12' W, a
distance of 178 feet, more or less, to a point, said point
being the true point of beginning; thence continuing
N 010 12' W, a distance of 1,084.4 feet to a point, thence
S 830 00' E, a distance of 365 feet to the Northeast corner
of Lot 4, PALMER ACRES; thence S 000 29' E, along the East
line of PALMER ACRES, a distance of 1,262.40 feet to the
