AN ORDINANCE RATIFYING, CONFIRMING AND RECORDING CHANGE IN THE BOUNDARIES
OF THE
CITY OF TIGARD BY THE BOUNDARY COMMISSION, ORDER No. 1406 , INVOLVING LANDS OF RIBACK,
SOUTHWEST QUARTER OF SECTION 11, TOWNSHIP 2 SOUTH, RANGE-IMT, WILLAMETTE MERIDIAN,
WASHINGTON COUNTY, OREGON, RECORDING EFFECTIVE DATE AND DECLARING AN EMERGENCY.
WHEREAS, the Boundary Commission established pursuant to Chapter 494
Oregon Laws of 1969 for the Portland Metropolitan Area, by its final order
dated April 12� 1979 approved the hereinafter described change in
the boundaries of the City of Tigard, and a copy of said final order has been
filed with the City Recorder.
NOW, THEREFORE,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section L: That the final order of the Boundary Commission adopted on the
12th day of April, 1979 , a copy whereoF is hereto
attached and by this reference made a part hereof, be, and the same is, hereby
ratified, confirmed and adopted by reference to the same legal force and effect
as if set forth herein in full.
Section 2: That the boundaries of the City of Tigard be, and they are hereby,
changed to include the lands as described in the within order of the
Boundary Commission, and the corporate Limits of the City of Tigard are hereby
changed in conformity therewith.
Section 3: That the Recorder of the City of Tigard be, and she is hereby,
directed to forthwith file a copy of this ordinance, including a
copy of said Order, in the following offices:
(a) Secretary of State
(b) Department of Revenue and Taxation, Washington County
(c) Department of Records and Elections, Washington County
(d) Department of Public Works, Attention: Surveyor,
Washington County
Section 4:- That the City Planning Commission be, and it is hereby, authorized
and directed to conduct such proceedings as may be necessary to
conform the authorized zoning and land use of the described premises to .the
requirements of the City's Zoning Map and Code.
Section 5: Inasmuch as it is necessary for the peace, health and safety of the
People of the City of Tigard that the foregoing change in the
boundaries of the City become a permanent part of the City's records, an emergency
is hereby declared to exist, and this ordinance shall be effective upon its passage
by the Council, and approval by the Mayor. ,

FINAL ORDER
RE: BOUNDARY CHANGE PROPOSAL NO. 1406 - Annexation of territory to
the City of Tigard.
Proceedings on Proposal No. 1406 commenced upon receipt by the
Boundary Commission of a petition from property owners on March 2 ,
1979 requesting that certain property be annexed to the city.
The petition meets the requirements for initiating a proposal set
forth in ORS 222 .170 and paragraph (a) Section (4) of ORS 199.490 .
Upon receipt of the petition, the Boundary Commission published and
posted notice of the public hearing in accordance with ORS 199.463
and conducted a public hearing on the proposal on April 12 , 1979.
The Commission also caused a study to be made on this proposal
which considered economic, demographic and sociological trends and
projections and physical development of the land.
FINDINGS
On the basis of the public hearing and the study, the Boundary
Commission found that :
1. The territory to be annexed is contiguous to the city and contains
3. 89 acres , 1 single family residence, a population of 1, and
is evaluated at $66,500.
2 . The petitioner desires annexation to obtain city services ; no
specific development pians have been submitted.
3. The proposal is in conformance with LCDC goals #1, 2, 3, 10 , 11
and 14. Goals #4 - 10, 13 and 15 - 19 do not apply here.
4. The area is identified as Urban on the county framework plan.
Current-- county zoning is RU-4.
S. The city plans the area for immediate urbanization and suitable
for Urban Low Density. The territory is within an unincorporated
island within the city.
6. The territory receives water service from the Tigard Water
District which also serves the city. The district has an 18-inch
main in SW 98th Ave. and a 4-inch main in SW Sattler St.
7. The city can provide gravity sewer service to the property
from an existing 8-inch main located approximately 175 feet
south of SW 100th Ave.
8. Fire protection is provided by the Tualatin RFPD which also
serves the city. The proposal will not adversely impact the
district.

REASONS FOR DECISION
On the basis of the findings , the Commission determined that:
1. The city ha$ a full range of services adequate to serve the area
available immediately upon annexation. The area is a logical
part of the city since it .is surrounded by the city.
2. The proposal is in conformance with city, county, and regional
planning as: well as LCDC Goals .
ORDER
On the basis of the findings and reasons listed above , the Boundary
Commission approved BOUNDARY CHANGE PROPOSAL NO. 1406 on April 12 ,
1979.
NOW THEREFORE IT IS ORDERED THAT the territory described in Appendix
"A" and depicted on the attached map, be annexed to the City of
Tigard as of this date.

Annexation
CITY OF TIGARD
A parcel of land located in the Southwest quarter of Section 11, Township
2 South, Range 1 West, Willamette Meridian, Washington County, Oregon,
being' more particularly described as follows:
Beginning at the Southwest corner of Lot 9, Alderbrook Farm, a subdivision
of record in Washington County; thence South 890 58' East, along the South
line of said Lot 9, a distance of 333.30 feet, to the Southeast corner of
said Lot 9; thence North 000 19' East, along the East line of said Lot 9,
a distance of 445.35 feet, to a point on said East line of said Lot 9, thence
North 890 58' West, a distance of 146.85 feet, to a point; thence North
000 19' East, a distance of 208.05 feet, to a point on the North line of
said Lot 9, said North line also being the centerline of S.W. Sattler Road
(County Road No. 857); thence North 890 58' West, along said centerline,
