AN ORDINANCE RATIFYING, CONFIRMING AND RECORDING CHANGE IN THE BOUNDARIES OF THE
CITY OF TIGARD BY THE BOUNDARY COMMISSION, ORDER No. 1319 , INVOLVING LANDS OF
USA DURHAM PLANT, SECTION 14, TOWNSHIP 2 SOUTH, RANGE 1 WEST, W.M.
WASHINGTON COUNTY, OREGON, RECORDING EFFECTIVE DATE AND DECLARING A-% EMERGENCY.
WHEREAS, the Boundary Commission established pursuant to Chapter 494
Oregon Laws of 1969 for the Portland Metropolitan Area, by its final order
dated net-nbE'r 18,^ 1978 approved the hereinafter described change in
the boundaries of the City of Tigard, and a copy of said final order has been
filed with the City Recorder.
NOW, THEREFORE,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: That the final order of the Boundary Commission adopted on the
18th day of October, 1978 , a copy whereof is hereto
attached and by this reference made a part hereof, be, and the same is, hereby
ratified, confirmed and adopted by reference to the same legal force and effect
as if set forth herein in full.
Section 2: That the boundaries of the City of Tigard be, and they are hereby,
changed to include the lands as described in the within order of the
Boundary Commission, and the corporate limits of the City of Tigard are hereby
charged in conformity therewith.
Sectior. 3: That the Recorder of the City of Tigard be, and she is hereby,
directed to forthwith file a copy of this ordinance, including a
copy of said Order, in the following offices:
(a) Secretary of State
(b) Department of Revenue and Taxation, Washington County
(c) Department of Records and Elections, Washington County
(d) Department of Public Works, Attention: Surveyor,
Washington County
Section 4: That the City Planning Commission be, and it is hereby, authorized
and directed to conduct such proceedings as may be necessary to
conforn tite authorized zoning and land use of the described premises to the
requirements of the City's Zoning Map and Code.
Section 5: Inasmuch as it is necesscry for the peace, health and safety of the
people of the City of Tigard that the foregoing change in the
boundaries of the City become a permanent part of the City's records, an emergency f'
is hereby declared to exist, and this ordinance shall be effective upon its passage
by the Council, and approval by the Mayor.

FINAL ORDER
RE: BOUpARy CM4M PROPOSAL NO. 1319 - Annexation of territory to the
City of Tigard.
Proceedings on Proposal No. 1319 eonmrenced upon receipt by the Boundary
Commission of a resolution from Tigard City Council on September 7, 1978
requesting that certain property be annexed to the city. The resolution
meets the recpairements for initiating a proposal set forth in ORS 199.490,
particularly paragraph (a) of Section (1).
upon receipt of the resolut4 , the Boumdary Cormiscion published and
posted notice of public hearing in accordance with ORS 199.463 and conducted
a public hearing on the proposal on October 18, 1978. The Commission also
caused a study to be made on this proposal which considered economic,
demographic and sociological trends and projections and physcial
developemait of the land.
FINDINGS
On the basis of the public hearing and the study, the Boundary Commission
found that:
1. The territory to be annexed is contiguous to the city and contains
61.85 acres and the Durham Sewage Treatment Plant.
2. Tne City of Tigard desires the annexation as a step toward making the
city's boundaries more logical.
3. In submitting the petition, one property amed by the Unified Sewerage
Agency, Tax Lot 202, NW a Sec. 13, T2S R1W, W.M. was inadvertently
omitted from the proposal. The proposal could be modified to include
this parcel.
4. The City of Durham's plan states an intent to serve the unincorporated
territory north of its boundary.
5. The City of Tigard's Corprehensive Plan provides for institutional
uses around the sewage treatment plant and designates the area-north
of Durham Rd. as Urban Lour Density, providing for 4 units per acre.
6. The Durham Cmprehensive Plan provides for the sante density as does
the Tigard emprehensive Plan.
7. Washington County planning has included the area in the city of rigard's

8. The proposal is in conformance with all applicable LCDC Goals.
9. Water service to the area is provided by the Tigard Water District
which also serves the City of Tigard.
10. The territory to be annexed contains the U.S.A. Sewerage Treatment
Plart. No other development is projected for the site. The
unincorporated area is traversed by the Fa*nc Creek Interceptor.
The surrounding unincorporated area relates to the City of Tigard
sewer system and this service can be provided by Tigard as development
takes place. The City of Durham does not provide sewer service.
11. The area is within the Tualatin RFM which also serves the cities of
Tigard and Durham. The fire district will not be affected by the

for the City of Tigard to have the general surrouding unincorporated
area within its boundary.
REASONS FOR DECISION
On the basis of the findings the Commission determined that:
1. The proposal is a step toward the creation of logical boundaries
for the City of Tigard. The property proposed to be annexed is within
an unincorporated area planned for in¢nediate urbanization.
2. The City of Tigard is capable of prodiding for a full range of urban
services to the area.
3. Bringing the territory within the bounaaries of the City of Tigard
will iaprove the effiency and economy of service provision to the
general area.
4. The proposal is in conformance with the City of Tigard, Washington
County and CRAG planning for the area, and is in conformance with all
applicable LCDC goals.
ORDER
On the basis of the findings and reasons listed above, The Boundary Cma'nission
approved BOUNDARY CHANCE PROPOSAL NO. 1319 as modified on October 18, 1978.
NOW THEREFORE IT IS ORDERED THAT the territory described in Appendix °A"
and depicted on the attached map, be annexed to the City of Tigard
as of 45 days from this date or at what other subsequent date uat u

A parcel of land in the Northwest quarter of Section 13 and in the North-
east quarter of Section 14, Township 2 South, Range 1 West, Willamette
Meridian, Washington County, Oregon, being more particularly described

Beginning at the Northeast corner of said Section 14; thence South,
along the East line of said Section 14, a distance of 802.25 feet, more
