AN ORDINANCE RATIFYING, CONFIRMING AND RECORDING CHANGE IN THE BOUNDARIES OF THE
CITY OF TIGARD BY THE BOUNDARY COMMISSION, ORDER No. 1260 , INVOLVING LANDS OF
EGGERT ANNEXATION, SECTION 35, T1S, RANGE 1 WEST, WILLAMETTE MERIDIAN,
WASHINGTON COUNTY, OREGON, RECORDING EFFECTIVE DATE AND DECLARING AN EMERGENCY.
WHEREAS, the Boundary Commission established pursuant to Chapter 494
Oregon Laws of 1969 for the Portland Metropolitan Area, by its final order
dated July 5, 1978 approved the hereinafter described change in
the boundaries of the City of Tigard, and a copy of said final order has been
filed with the City Recorder.
NOW, THEREFORE,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: That the final order of the Boundary Commission adopted on the
5th day of July, 1978 _ _ , a copy whereof is hereto
attached and by this reference made a part hereof, be, and the same is, hereby
ratified, confirmed and adopted by reference to the same legal force and effect
as if set forth herein in full.
Section 2: That the boundaries of the City of Tigard be, and they are hereby,
changed to include the lands as described in the within order of the
Boundary Commission, and the corporate limits of the City of Tigard are hereby
changed in conformity therewith.
Section 3: That the Recorder of the City of Tigard be, and she is hereby,
directed to forthwith file a copy of this ordinance, ir.,�luding a
copy of said Order, in the following offices:
(a) Secretary of State
(b) Department of Revenue and Taxation, Washington County
(c) Department of Records and Elections, Washington County
(d) Department of Public Works, Attention: Surveyor,
Washington County
Section 4: That the City Planning Commission be, and it is hereby, authorized
and directed to conduct such proceedings as may be necessary to
conform the authorized zoning and land use of the described premises to the
requirements of the City's Zoning Map and Code.
Section 5: Inasmuch as it is necessary for the peace, health and safety of the
people of the City of Tigard that the foregoing change in the
boundaries of the City become a permanent part of the City's records, an emergency
is hereby declared to exist, and this ordinance shall- be effective upon its passage
by the Council, and approval by the Mayor.

FINAL ORDER
RE: BOUNDARY CHANGE PROPOSAL NO. 1260 - Annexation of territory to the
City of Tigard.
Proceedings on Proposal No. 1260 commenced upon receipt by the Boundary
Commission of a petition from a property owner on May 26, 1978 requesting that
certain property be annexed to the city. The petition meets the requirements
for initiating a proposal set forth in ORS 222.170 and paragraph (a) Section (4)
of ORS 199.490.
Upon receipt of the petition, the Boundary Commission published and posted
notice of the public hearing in accordance with ORS 199.463 and conducted a
public hearing on the proposal on July 5, 1978. The Commission also caused a
study to be made on this proposal which considered economic, demographic and
sociological trends and projections and physical development of the land.
FINDINGS
On the basis of the public hearing and the study the Boundary Commission found
that:
1. The territory to be annexed is contiguous to the city and contains .40 acres,
one single family residence, a population of 2, and is evaluated at $25,400.
2. The property owne. desires city services; no plans for development are proposed.
3. The adopted Tigard Community Plan designates the site Urban Low Density Residential.
4. The Washington County Framework Plan designates the area Urban. Current county
zonim is A-2.
5. The CRAG designates the site Urban and it is within the Interim Immediate
Growth Area.
6. The proposal is in compliance with applicable LCDC Goals.
7. Sewer service is available immediately upon annexation from an 8-inch main
located in Greenburg Rd.
8. The territory is within the Metzger Water District which has a 6-inch main
fronting the property in Greenburg Rd.
9. The territory is within the Tualatin RFPD. The district will not be affected
by annexation.
REASONS FOR DECISION
On the basis of the findings the Commission determined that:

1. The proposal is consistent with all applicable land use plans and j
LCDC Goals.
2. A full range of services will be available to the property innediately
upon annexation.
ORDER
On the basis of the findings and reasons listed above, the Boundary Commission
approved BOUNDARY CHANGE PROPOSAL N0. 1260 on July 5, 1978.
N(11 THEREFORE IT IS ORDERED THAT the territory described in Appendix "A" and
depicted on the attached map, be annexed to the City of Tigard as of this date.

Annexation
CITY OF TIGARD
That portion of land in Section 35, Township 1 South, Range 1 West,
Willamette Meridian , Washington County, Oregon, being more par-
ticularily described as follows:
Beginning at an iron pipe on the north line of Lot 7 of GREENBURG
_ .HEIGHTS, a subdivision of record in said County , said pipe being
South 000 02' {Vest 298 feet and South 590 34' West 20 :feet from the
initial point of said subdivision; thence South 000 02' West, along
the west line of a 20 foot wide roadway as shown on said plat, 180.6
feet to the true point of beginning of this description; thence
continuing South 000 02' Nest 201.7 feet to a point on the Southerly
line of said Lot 7 in the center of County Road No. 179 (SW Greenburg
Road) , from which point an iron pipe bears North 000 02' East 31.7
feet; thence North 71 06' West along; the center of said County road
127.35 feet to a point from which an iron pipe bears North 000 021
East 31 .7 feet thence North 000 02' bast , parallel with the east line
of Lot 7, a distance of 159.6 feet to an iron pipe; ' thence South
890 34 ' East a distance of 120. 55 Peet to the true point of beginning
