Ordinance No. 78-18 t CITY OF TIGARD, OREGON ORDINANCE No. 78 - AN ORDINANCE PROVIDING FOR A SPECIAL CITY ELECTION TO BE HELD IN THE CITY OF TIGARD, OREGON, ON MAY 23,, 1978, IN CONNECTION WITH THE GENERAL STATE PRIMARY ELECTION, FOR THE PURPOSE OF SUBMITTING TO THE LEGAL VOTERS OF THE CITY OF TIGARD, OREGON, THE QUESTION OF ESTABLISHING A NEW TAX BASE PURSUANT TO SECTION 11, ARTICLE XI, CONSTITUTION OF THE STATE OF OREGON AND DECLARING AN EMERGENCY. WHEREAS, the Council of the City of Tigard has determined that sufficient funds to properly operate the essential functions of the City of Tigard cannot be made available within the limits of the presently existing tax base of the City and that there should be submitted to the legal voters of the City the question of establishing a new tax base in accordance with the provisions of Section 11, Article XI, Oregon Constitution; and WHEREAS, pursuant to Section 11, Article XI, Oregon Constitution, it is necessary to submit such question of establishing a new tax base to the legal voters of the City at the state-wide primary election to be held on May 23, 1978; NOW, THEREFORE, THE CITY OF TIGARD DOES ORDAIN AS FOLLOWS: Section 1: The Council finds that it is necessary and in the best interests of the people of the City of Tigard that there be submitted to the legal voters of the City at the regular state-wide primary election to be held and conducted at all voting precincts within the City and throughout the state on May 23, 1978, and as a part thereof, the proposition hereinafter stated in accordance with Section 11, Article XI, Constitution of the State of Oregon. Section 2: That there should be submitted to the legal voters of the City of Tigard voting at each precinct, or part thereof, within the City at the said primary election of May 23, 1978, the following proposition for which purpose the following ballot title, number and form in which the question shall be printed upon the official ballot is presented: SAMPLE BALLOT City of Tigard, Oregon Special Election May 23, 1978 TAX BASE PROPOSAL Explanation of the Ballot Question This proposal is referred to the legal voters of the City of Tigard for the readon that the amount of taxes that may be levied by the Council of the City of Tigard within the present tax base is insufficient to cover the necessary functions of the City. is PAGE 1 4' ORDINANCE No. 78- " r If passed, the total City tax rate for fiscal year 1978-79 is estimated to be $1.62 per $1,000 True Cash Value, which equals $ 64.80 total tax for a home assessed at $40,000. Shall the tax base for the City of Tigard be established at $ 500,000 in lieu of the amount effective for the current fiscal year, which is $183,929. YES I vote in favor of the proposed tax base. NO I vote against the proposed tax base. Section 3: The City Recorder is hereby authorized and directed to certify in the manner provided by law to the Department of Records and Elections of Washington County, the foregoing measure for inclusion as a part of the regular ballot to be prepared by the Department of Records and Elections for voting at all precincts within the City of Tigard at the state-wide primary election of May 23, 1978. Section 4: In all respects the conduct of the election on the tax base proposition shall conform to the procedures established pursuant to law for the conduct of the primary election in said precincts and the polls shall be opened at the same hour and closed at the same hour and all other applicable provisions in accordance with the election laws of the State of Oregon shall be respected. Section 5: Notice of the City tax base proposal in form substantially as hereinafter set forth shall be given by three weekly publications in the Tigard Times on May 3, 10, and May 17, 1978, and by posting notice substantially in the following form in the following designated places, such posting be accomplished not later than 'April 28, 1978: PAGE 2 ORDINANCE No. 78- (a) At the front door of the City Hall exposed to public view, 12420 SW Main Street, Tigard, Oregon. { (b) In one public place in each voting precinct, or part thereof, within the City. (c) At each polling place. The City Recorder is directed to cause to have published and posted said notices and shall file in the records of the City, an affidavit of posting it form prior to May 5, 1978. The form of notice shall be substantially as follows: NOTICE OF PROPOSAL TO ESTABLISH A NEW TAX BASE CITY OF TIGARD, OREGON TO BE SUBMITTED TO LEGAL VOTERS OF TIGARD AT PRIMARY ELECTION OF MAY 23, 1978 Notice is hereby given that pursuant to Ordinance No. 78-18 t enacted by the City Council of Tigard on March 21, 1978, at the State of Oregon primary election of May 23, 1978, between the hours of 8:00 o'clock A.M. and 8:00 o'clock P.M. at each precinct within the City of Tigard, there will be submitted to the legal voters of the City of Tigard..for their approval or rejection a a tax base proposal as set forth in the following facsimile sample ballot: a SAMPLE BALLOT City of Tigard, Oregon i Special Election - May 23, 1978 TAX BASE PROPOSAL €' Explanation of the Ballot Question: E This proposal is referred to the legal voters of the City of Tigard for the reason that the amount of taxes that may be levied by the Council of the City of Tigard within the present tax base is insufficient to cover the necessary functions of the City. NOF I vote against the proposed tax base. The foregoing proposition, if adopted, will establish a new tax base for the City of Tigard pursuant to Section 11, Article XI, Oregon Constitution. The polling places in the City of Tigard for the purpose of submitting the foregoing proposition will be the same as those designated for the state-wide primary election of May 23, 1978, and the election will be conducted in all respects by the same election boards as designated and appointed for the state-wide primary election. By Order of the City Council Doris Hartig, City Recorder Section 6: That the Council of the City of Tigard deems it unnecessary for the City of Tigard, or any officer thereof, to furnish the legal voters of the City any tax base election pamphlets containing the text of the proposition or arguments in support of or in opposition to the proposition. Section 7. It is necessary for the preservation of the public peace, health and safety of the people of the City of Tigard thatthisordinance take effect immediately in order that the tax base proposal may be properly submitted to the people of the City of Tigard at the state-wide primary election of May 23, 1978, and an emergency is hereby declared to exist and this ordinance shall be effective upon its passage by the Council and signature of the Mayor.
