ORDINANCE NO. 78-
AN ORDINANCE AMENDING CHAPTER 18.57 OF THE TIGARD MUNICIPAL CODE BY
CHANGING THE MAPS REFERRED TO IN THE DEFINITION OF FLOODPLAIN DISTRICT,
THUS SUPERSEDING SECTION 18.57.020 (5) AS ADOPTED BY ORDINANCE
NO. 74-50A, DECLARING AN EMERGENCY, AND FIXING AN EFFECTIVE DATE.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: The City Council finds that Section 18.57.020 (5) de-
fining the Floodplain District refers to contradictory
flood plain information, in that the U.S. Army Corps of Engineers
data is not accurately mapped on maps, marked Exhibit "A", and
titled, "FLOOD PLAIN," and otherwise described as "HUD 701 Project
No. 73-16-06," plates number 4 and number 5.
Section 2: The City Council finds that the maps marked Exhibit
"A" as described in Section 1 above and referenced in
18.57.020 (5) are.. not the most detailed (large-scale) maps
available, since the City has quarter-section topographic maps with
2 foot contour intervals at scale 1:100 (1"=100' ) whereas the
Exhibit "A" maps are at scale 1:12,000.
Section 3: The City Council finds that the Tigard Planning Depart-
ment has developed flood plain maps, marked Exhibit "B"
and titled "City of Tigard and Vicinity - Environmental Constraints",
which more accurately depict the floodplain information of the U.S.
Army Corps of Engineers and other agencies at scale 1:1001 .
Section 4: The Council further finds that the National Flood In-
surance Administration has relied upon the maps marked
Exhibit "B" in the development of its maps for determining property
eligible for federally-subsidized flood insurance.
Section 5: In furtherance of the above findings, the City Council
hereby determines that Section 18.57.020(5) of the Tigard
Municipal Code, is superseded by the following:
(5) "Floodplain District" is
defined as those areas within the City of Tigard in-
undated by the one hundred year regulatory flood as shown
on maps marked Exhibit "B'', titled "City of Tigard and
vicinity Environmental Constraints."
Section 6: Inasmuch as flooding in the City has on occasion caused
significant property and financial losses and has threat-
ened serious injury and loss of life; and prevention and reduction of

future losses requires effective control over land uses within areas
subject to inundation; and such regulation requires reference to
the most accurate information available, including maps; an emergency
is recognized to exist and is hereby declared and this ordinance
shall become effective immediately upon passage and approval by the
City Council.
