2. That ten feet of right-of-way be dedicated along S.W. Sattler
for street improvement purposes.
3. That a covenant be attached to the deed of any lots abutting S.W.
Sattler Street and Hall Boulevard restricting direct access to
Sattler Street and Hall Boulevard unless otherwise approved by
the Tigard Planning Department.
4. That the home on Tax Lot 6401 be allowed temporary access to
Hall Boulevard until such time as the street which will
provide access to this lot has been constructed.
S. A storm water system plan and a water retention plan conforming
to Washington County standards be submitted to the Public Works
Department prior to final plat approval.
6. That a half street improvement to collector street standards be
made on the S.W.Sattler Street frontage. No final plat will be
recorded until construction drawings have been approved by the
Public Works Department and the necessary bond filed.
7. That a ten foot easement to the public with a six foot wide
asphalt walkway be provided adjacent the lot lines of Lots 19
and 20 for access to the "nature park" and the path continue

The partial master plan was approved by the Planning Commission on their
August 2, 1977, meeting, subject to fifteen conditions as detailed in a
letter of AU-
U.+ ,4Zi, 1977, to a Mr. Bruce Ber-eyl 19285 Saga Tualatin
Valley Highway' Aloha, Oregon. Mr. Bergey presented your staff and
Planning Commission with a genaral plan which you had reviewed on the
above mentioned date. Since that date, Mr. Bergey has lost his option
and my clients, Mr. Bill Godwin, Mr. Bob Westlund., and Mr. Fred Wordin,
have purchased the property and wish to continue the planning process
that Mr. Bergey began.
After having reviewed the general plan which Mr. Bergey was proposing and
the fifteen conditions which the Tigard Planning Commission had placed on
the parcel, I felt that some serious considerations should be given to
some major design revisions. My first observation on the property was
its characteristic open and rolling- terrain with some very substantial
trees located on the westerly portion of the property. (You can see the
tree boundary shown on Sheet two of two on our proposed plan.)

The project we propose can be seen on Sheets one and two of the tentative
plan. The project area consists of Tax Lot 6400 having 16.49 acres, a
park of approximately 1.4 acres, dedication on S.W. Stattler of .25 acres,
the number of lots - 60, there are no existing residences in this area,
the proposed use —single family, the water supply - Tigard,. sewerage P
City of Tigard, average lot size of 7775 square fegt, the smallest lot
being approximately 6300 square feet with a minimum lot size, as suggested
in your August 5 letter, of 6,000 square feet. Tax Lot 6401, the adjacent
area to the east, is approximately 2.43 acres, no area given to park site)

residence, proposed use - single family, water supply - Tigard, sewerage -
City of Tigard, approximate average lot si.:a is 9750 square feet, smallest
lot-is 8,000 square feet, and the allowable lot size for that zone is j
7500 square feet. Proposed off-site improvements to this site include a
half street improvement of 1,070 feet along-S.W. Stattler Street, the j
extention of the City of Tigard Water District's 12-inch water line from
its existing ending on S.W. Statt'Pr Street to S.W. Ball with approximately
1470 feet of pipe. The d.,!i:icatio f an additional ten feet along S.W.
Stattler and the dedicatiin of an additional fifteen feet on. S.W. Hall.
The sewer would be brought into the area by one of the two proposed routes
as shown on Sheet one of two of the proposed plan.
I think the proposal has sev;;rai unique facets. :t retains the single family
concept, but allows for the rn;tention of the major trE:�s which exist on the
site. This will be discuss,: 1�;ter. Alsc by Vie proposed alignments ,f the
streets within this subdivisiin, we can utilize the existing drainage ,)aths,
thereby not having to reshape the topography of the site to any major -xtent.
Now to answer the conditions as stated in your August 5, 1977, letter..
1. This condition was to prepare a plan showing the development pattern
for Tax Lot 6401. This can be found on the easterly side of the pro-
posed project on Sheet one.of two. The lotting pattern shows eight
lots. One of the-lots, ##63, has the existing residence shown. These
lots have been designed larger than the required size of 7500 square
feet to allow for the houses to be built as far as possible from the
traffic noise which will occur on S.W. Hall Blvd. when it is improved
to its future standard. These lot sizes also afford the possibility
of creating earth berms along Hall-Blvd. to help shelter these homes
sites from S.W. Hall Blvd.
2. As per a telephone conversation with you, the final agreements with
. the owner of Tax Lot 6401 aro being prepared and his signature on the
final plat can be obtained.
3. Typical sections of the proposed street improvements can be found on
Sheet one of two of the proposed,plan. The typical street would be
that having a 34 foot, of paved surface, type "'C" curbs with a fire
foot walkway abutting the curbs. The typical path, again as shown

on Sheet one of two, would be a six foot paved AC path meandering
within a.ten foot dedicated pathway right--of-way. The proposed half
street on S.W. Stattler will be designed to the standards specified
by your public 'Works Department at a later date. The area in the
northerly portion where there are tress.with a caliper diameter of
6-inchas and over, should have the leeway in design to affect a
standard section change to a minimum of 28 foot of paved surface
meandering within the fifty foot proposed right-of-way to avoid,
where possible, any major trees. By narrowing and meandering the
street section within this area, it is my opinion that more of the
trees can be protected and saved.
4. A survey showing the location of the major- tees can be shown on
Sheet two of two of the prupcsed plan.
5. That the lotting pattern gave a miaimurr, cf 5) f.�3t at the property
line. Under this condition, we have exceadel this requirement in
all but eight of our lots. Lots 30 and 31 hive combined a fifty
foot f'ronteve with a proposal of a common driveway access leading
to them. Both of these lots are exceptionally large and from their
character and nature lend themselves very well to a narrowing of this
requirement. The same is also true of Lots 32, 33, 34, 37, and 38
as they are all of substantial size and substantial width at the
property line 'to provide amore than adequate driveway to the resi-
dence. Lots 39 and 40 are similar in nature to the aforementioned
Lots 30 and 31.
6. Dedication of 25 feet along S.W. Hall Blvd. is shown on Sheet 1 of 2.
7. Dedication of 10 feet along S. W. Stattler is shown on Sheet 1 of 2:
S. This condition states that there will be no access to S.W. Stattler
Street unless approved by the Tigard Planning Department. All of our
lotting pattern and access will be to the interior streets and then
out t2irough. to S.W. Stattler with only a street access to S.W. Stattler
and no direct lot access. The existing residence on Tax Lot 6401 now
has a driveway access which goes onto S.W. Stattler. At the time the
street improvements are completed on the entire project, he will then
f be able to access directly onto the interior street.
9. The storm sewer system for on-site detention in my opinion should be
addressed in detail with the final construction plans of this project.

on-site detention. One being oversized piping within the street
section to provide detention. Also the dedicated park area in the
northerly portion of this project, with some minor improvements,
could provide this detention. On-site detention is a complex design
function and should be completed only after street grades and other
design criteria for the project have been set. The on-site storage
of water from rainfall affords the ground a chance to replenish
its ground water supply while detaining the peak runoff of the
storm for a period of time so as to not overtax the downstream
drainage area by the increased load caused by the improvement of
this property. The method for computing or analyzing this detention
is handled by adjacent jurisdictions in two ways. The City of Beaverton
requires 540 cubic feet of on-site detention for every acre of develop-
able land. Ldashington County Department of Public Works requires that
the on-site detention be equivalent to the difterance .between a 25
year storm with the property developed and a 25 year storm with the
property in existing conditions. With these methods which have been
utilized by the surrounding governmental jurisdictions, i feel it
will be quite easy to affect on the final design an on-site detention
appropriate for this property and in compliance with your Public Works
Department requirements.
10. The half street improvement on S.W. Stattler will be part of the con-
struction plans for this project and will be made a part of the coh-
struction plans of. this project so your department can approve theca
as a unit package.
11. The ten foot required pathway right of ways are shown on Sheet one
of two of the proposed plan. These paths as proposed afford a pedes-
trian the ability to walk from S.W. Stattler to the nature park on
the northerly portion of this project. The interior lots, as shown
on Sheet one of two will have a five foot side walk area affronting
their property and it will be quite easy to provide the walking cir-
culation that anyone living in this community would desire.
12. Street intersections be aligned to intersect as closely to 90 degrees
as possible. One can see by reviewing Sheet one of two of the proposed
plan that the streets have been aligned as nearly as possible to this
criteria.
13• Required the dedication of a 61,000 square foot nature park located
in the northwesterly portion of the property. This park will be shown
as a tract on the final plat with a dedication transferring ownership
of it to the City of Tigard, as requested.

14• The minimum lot size be no less than 6,000 square feet. We have
maintained throughout this project a lot size substantially higher
than the miniMM specified hoping to afford the builder the avail—
ability of achieving very desirable home sites with enough area to
havea, Ysmy satisfied with their it liv environment.

15. An active play area with suitable play equipment be incorporated f
into then development. ' As you can see on the proposed plan,_ we
have not included the play area. It is my opinion that with the
dedication of the 61000 square x".eet nature park:, that play equip—
ment would be more available if installed in this large area, par
ocularly the northwesterly corner which is of a topography which
would afford an area for picnic tables and play equipment. The
lot sizes throughout the project have been held above the minimum
allowable to afford play area on the individual lots. It has been
my past experience that some mini parks with play equipment, soon
after the developer leaves, fall into disrepair and becomes only an
area for people to walk their dogs.
I hope this answers the majority of the questions on this proposed project;
and if 1 can be of any further assistance or answer any questions, please

I. Findings of Fact:
1. The applicants are requesting general plan and program re-
view in accordance with Section 18.56.030 of the Tigard
Municipal Code for an 18.92 acre (68 lot) residential
planned development at S.W. Sattler Street and Hall Boule-
vard. �.
2. The site is designated "Urban Low Density Residential" on
both the Tigard Community Plan, 1971, and NPO 6 Draft Plan.
3. Applicable policies from the Community Plan, 1971, are the
following:
o The maximum overall density of development will be four
dwelling units or 12 persons per gross acre. This
amounts to a standard of 7,500 square feet of land per
dwelling unit, allowing for streets and other open
space. Some areas will have a lower density owing to
topography; existing development patterns or the desire
of individuals to own a larger Lot.
o Planned unit development will be encouraged on tracts
large enough to accommodate ten or more' dwellings.
Planned unit development will permit a degree of flexi-
bility in design that will enable a higher quality of
development in accordance with zoning standards.
4. Section 18.56.010 of the Tigard Municipal Code states that:
Purpose. The purpose of the planned development district
is to provide opportunities to create more desirable

environments through the application of flexible and
diversified land development standards under a compre-
hensive plan and program professionally prepared. The
planned development district -is intended to be used to
encourage the appZicatiori of new techniques and new
technology to community development which will result
in superior living or development arrangements with
lasting values. It is further intended to achieve
economies in land development, maintenance, street sys-
tems, and utility networks while providing building
groupings for privacy, usable and attractive open
spaces, safe circulation, and the general well-being 'of
the inhabitants.
5. On August 2, 1977, the Tigard Planning Commission approved
the preliminary plan and program review for this proposed
development subject to the following conditions:
(1) That the applicant revise his planned development to
include the 200 by 540 foot wide parcel located in
the southeast corner of the lot and that a proposed
dotting pattern for this area, as well as a street
system designed to provide access to those lots, be
submitted as part of the general plan and program.
(2) That the applicant obtain from the owner of the 2(10 �
by 540 foot wide parcel a written consent for having -
this area be included 'in the final plat.
(3) That cross sectional diagrams showing the proposed
standards for the street system be submitted with the
general plan and program.
(4) That a survey showing the location of the major trees
on the site be submitted with the general plan and
program.
(5) That the lotting pattern be revised to meet a minimum
lot width of 50 feet at the property line and no more
than 61 units be allowed (exclusive of illegally par-
titioned area) and that the loop street have a mini—
mum paving width of 28 feet.
(6) That ten feet of right-of-way be dedicated along S.w.
Hall Boulevard for street improvement purposes (un-
less

tion of this zone change) .

II. Staff Observations:
1. Mr. Bruce Burgey, the original applicant, had his option
expire to develop this property; and Messrs. Godwin, West-
lund, and Wordin have since purchased the property and are
proposing to develop- this parcel jointly with Mr. Francis
Scheckla, owner of the 200 by 540 foot parcel in the south-
east corner of the development (Hall and Sattler) .

2. The applicants have essentially incorporated into their
general plan and program the conditions of preliminary
plan approval with the following exceptions:

Condition 9
The applicants feel that it would. be more appropriate to '
submit a design for a storm water system with the final
construction plans, so that street grades and design cri-
teria for the project can be established and a storm water
system designed accordingly.
Condition 15
The applicants feel that, since an active play area with
play equipment will be provided in the. "park area" and
that there has been an overall increase in the size of the
individual lots from the previously submitted preliminary
plan, the provision of an additional active play area in
the development would not be necessary.
3. The average size of Lots 3. through 60 on Tax Lot 64D0 will
be 7,775 square .feet, with the smallest lot being 6,300
square feet. Lots 61 through 68's average size is approxi-
mately 9,750 square feet. The smallest of these lots
would be 8,000 square feet.

4. The applicants resubmitted site plan has made provisions
for a ten foot wide path between Lots 7, 8, 13 and Lots `
36 and 37, which had not been shown on the preliminary
plan.
5. Proposed deviations from the city's local street standards
are being requested by the applicants in the northwestern
corner of the site. In order that they may have the "lee-
way in design", the applicants are proposing to decrease
the required 34 feet of pavement to 23 feet within a 50
foot right-of-way and meander the paved surface to avoid
the loss of large trees within this area.
The applicants are also proposing to construct a half ' '
street improvement (25 foot right-of--way, 24 foot pavement,
five foot sidewalks to be provided on _an easement) and
cul-de-sac for Lots 13 through 16. Negotiations are cur-
rently being undertaken between the applicants and the ad-
jacent property owner to the east (Tax Lot 6300) to parti-
cipate in the development of a full street and cul-de-sac
for this area.

6. Access for the home on Lot 63 is currently being provided
from Hall Boulevard. she applicants are proposing to re-
strict access from this lot and Lots 62 through 67 to Hall
Boulevard and provide access to the rear of these on stan-
dard local street. Temporary access for the home on Tax
Lot 6401 (Lot 63) will continue from Hall Boulevard until
such time as A' street is constructed to the rear of this
lot.
7. Several large trees will have to be removed on the site to
facilitate the development of the streets. This fallen
timber could be incorporated within the design of the "park
area" by utilizing these trees as playground equipment in
the form of a large climbing apparatus.
III. Conclusionary Findings:
1. The applicants have adhered to the required conditions of
the preliminary plan and program and have supplied suppor-
tive information to justify any alterations or deletions
in those conditions imposed by the Planning Commission.
2. The provision for paths between Lots 7, 8, 13 and 36 and
37 does not appear necessary because the provisions of
sidewalks within the development will sufficiently facili-
tate the movement of pedestrians.

4. The proposed deviations from the local street standards
appear to be justified in order to preserve trees and com-
pliment the topography on the site.
5. The provision of the "park area" and the enlargement of
the lot sizes from the previously submitted preliminary
plan will provide the necessary open space and recreational
area which is in keeping with the purpose of the planned
development.
IV. Staff Recommendation:
Based on findings of fact and conclusionary findings, staff
recommends approval with the following conditions:

tions.
1. That 15 feet of right-of-way be dedicated along
the Hall Boulevard frontage for street improve-.
ment purposes.
2. That ten feet of right-of-way be dedicated along
S.W. Sattler for street improvement purposes.
3. That a covenant be attached to the deed of any
lots abutting S.W. Sattler Street and Hall Boule-
vard restricting direct access to Sattler Street

E. Commission Discussion:
o Corliss wanted clarification of pathway and believed
development was well presented.
o Sakata worried about other lots in the area.
o Brian questioned standards for recreational space,
who in fact would maintain natural park area, and
what warrants being a city park.
o Laws responded with recreational space standards
and stated that the city would maintain park area
o Goldbach expressed concern over condition of the
park area year round in regards to water
o Drinkwater stated all parts were accessible after a
rainfall.
o Popp commended the staff and applicants on the out-

Goldbach moved for approval and Brian seconded based
on staff recommendations.
The -motion-'was approved 'by unanimous voice vote.
5.2 Zone Change ZC 34-77 (Caffall) (Tabled from Planning Com-
mission meeting November 1, 1977)
A request by R. H. Caffall for a zone map amendment to
change the zoning designation from Washington County Zon-
ing RU-4 to City of Tigard Zoning "R-7", Single Family Re-
sidential, for a 1.59 acre parcel at the north side of
100th Street between Ash and McDonald (Wash. Co. Tax Map
2S1 2CD, Tax Lot 3100)
A. Staff Report:

B. Applicant's Presentation:
Bill McMonagle, of S.W. Commercial Street, stated they
had no objections to a zoning change.
C. Public Testimony:

D. Staff Recommendation:
Based on the findings of fact and conclusionary find-
ings;: staff recommends approval subject -to the. follow-
ing conditions:
1. Ten feet be dedicated along the McDonald Street
frontage and five feet be dedicated along the Ash
Street frontage'.
2. File with the City Recorder an .agreement not to re--
monstrate against a Local Improvement District for
street improvements to S.W. McDonald, S.W. 100th,
and S.W. Ash Streets.
