ORDINANCE No. 78 - 3
AN ORDINANCE AMENDING THE TRAFFIC CODE OF THE CITY OF TIGARD AND DECLARING
AN EMERGENCY.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
TITLE 10. VEHICLE AND TRAFFIC of the Municipal Code 6f the City of Tigard
is amended by this ordinance. It is the purpose of this ordinance to
simplify and clarify the procedures of the city's law enforcement system
without accomplishing changes in the substantive law, except where changes
in substantive law are necessary to cause the law to conform to the laws
of the State of Oregon as amended by the legislative sessions of 1975 and 1977.
Section (1) Chapter 10.04 Adoption Provisions (including Sections
10.04.010 through 10.04.060) is repealed.
Section (2) Chapter 10.08 Wreckers (including Sections 10.08.010
through 10.08.040) is repealed.
Section (3) Chapter 10.12 Operator and Chauffeur Licenses (including
Sections 10.12.010 through 10.12.080) is repealed.
Section (4) Chapter 10.16 Vehicle Operation and Ea2j2ment is renamed
Chapter 10.16 Traffic and Parking Regulations. (a) The following sections
of Chapter 10.16 are repealed:

(b) Section 10.16.020 is amended to read as follows:

Section 10.16. 020 One-T7ay Streets: The
followinstreets within the City of Tigard,
or the portions of those streets identified by
this section, are hereby designated one-way
streets. Traffic shall be permitted to move
in one direction only.
" (a) S. W. McKenzie Street from its inter-
section with the Westerly right-of-way line
�- of S. W. Pacific Highway to its intersection
i;- with the Fasterly right-of-way line of S. W.
Grant Avenue. Traffic is hereby permitted
to move only in a Northwesterly direction,
away from S. PI. Pacific Highway and toward
S. W. Grant Street. "
(c) Section 10.16.040 Right-of-way is amended to read as follows:
"Section 10.16.040 Right-of-way
(1) The following streets and locations are
designated stop streets. All traffic pro-
ceeding in the directions stated shall come
to a stop before proceeding into the designated
intersections: `
(a) Eastbound traffic on S. W. Center Street
shall. stop at or prior to the intersection .of
the west line of S. W. 87th Avenue G7ith the
south line of S: W. Center Street. p
(b) All traffic on S. W. 87th Avenue shall
stop at or prior to intersection of the south ,
line of S. W. Center Street with the west line
of S. W. 87th Avenue.

(c) Southbound traffic on S. W. Burlcr_est Drive
shall stop before entering its intersection with
S. W. Summercrest Drive.
(d) Westbound traffic on S. W. Lomita Avenue -
shall stop before entering its intersection with
S. W. 90th Avenue.

(e) Westbound traffic on S. W. Murdock Street
shall stop before its intersection with S. W. 96th
Street.
(f) All traffic on S. W. Grant at its intersection
t ' with S. F1. Johnson Avenue shall stop before entering r
the intersection.

(2) All traffic entering a collector street
or an arterial from a residential street
(other than a collector or arterial) shall
come to a stop before entering the collector
or arterial in obedience to a duly erected
stop sign or signal, except at those entry
points where traffic is required only to
yield, pursuant to a "yield right--of-way"
sign.
(3) All traffic entering an arterial from
a collector street shall come to a stop before
entering the arterial, 'in obedience to a duly
erected stop sign or signal, except at those
entry points where traffic is required only
to yield, pursuant to a "yield right-of-way"

(4) The designations of the streets within
the city as "arterial," "collector," and
"residential" shall be the designation
assigned to each of the streets and portions
of streets by the Tigard Comprehensive Plan.
Section (5) Chapter 10.20 Traffic Offense Procedures
is repealed.
Section (6) Chapter 10.24 School Busses is repealed.
Section (7) Chapter 10,32 Miscellaneous Provisions is
amended in the following respects:
(a) Section 10.32.020 P_uthority of city administrator
to have traffic control signs, markings, and signals installed is
amended to read as follows:
"10.32.020 Authority of city administrator
to have traffic control signs, markingsand
is fi .nals installedSubject to authoriut, vested
in the State Highway Commission and subject to
the relevant provisions of the laws of the State
of Oregon, the city administrator shall cause to
have erected, installed, and maintained appro-
priate signs, markings, and traffic control signals
as may be deemed necessary to direct and regulate
traffic and carry out the provisions of Chapters
10.16 through 10.32, including such signs as may t'
be appropriate to give notice of local parking
and other special regulations.

The erection and maintenance of such signs,
markings, and signals within the city by direction
of the city administrator shall be deemed an admin-
istrative act to be performed under the authority
granted by state law, and the provisions of Chapters
10.16 through 10.32.
(b) All references in Chapter 10.32 to "Chapters 10.04
through 10.32" are amended to read "Chapters 10.16 through 10.32."
(c) Section 10.32.250 Penalties is amended to read as
follows:
"10.32.250 Penalties Violation of
any provisionf this chapter is class
B traffic infraction."
Section (8) Chapter 10.36 Bicycles is amended to read
as follows:
(a) The footnote to the chapter* title is deleted.
(b) Section 10.36.030 is amended to read as follows:
"10.36.030 License-Issuance. City Police
Department is authorized and directed to issue
bicycle licenses. Bicycle licenses shall be
permanent, and shall remain valid during the
time the person who applies for and receive., the
license remains the owner of the bicycle."
(c) Section 10.36.040 is amended to read as follows:
"10.36.040License-Plate, Registration Card-
Inspectioon. License plates and registration cards
shall be provided by the city. Such license plates
and registration cards shall be issued only to
applicants who submit satisfactory proof of owner-
ship of the bicycle and demonstrate reasonable
knowledge of traffic safety rules. The City Police
Department shall inspect each bicycle before regis-
tration and licensing and shall refuse to issue a
license or registration for any bicycle determined
to be in unsafe mechanical condition. All license
plates shall be suitable for the attachment to the
frame of a bicycle at such place and in such manner
as the police department shall designate and one such
plate shall be issued for each bicycle. "

(d) The following sections are repealed:
10.36.080
10.36.090
10. 36.110
(e) Section 10.36.100 is amended by the addition of the
word "certain" in the title, making the title read: Section 10.36.100
Riding on Certain Sidewalks Prohibited.
Section (9) Except as amended by the language of this
ordinance Title 10 Vehicles and 'Traffic shall continue in effect.
Section (10) Because of the impending work on updating the
Tigard Municipal Code, an emergency is declared to exist. This
ordinance becones effective immediately upon its passage and signature.
