AN ORDINANCE AMENDING THE ZONING TITLE OF THE TIGARD MUNICIPAL CODE {
CHAPTER 18.20, SINGLE FAMILY RESIDENTIAL ZONE, SECTION 18.20.020,CONDITIONAL
USES, WITH RESPECT TO MINIMUM LOT REQUIREMENTS FOR A DUPLEX IN A SINGLE
FAMILY RESIDENTIAL ZONE AND DECLARING AN EMERGENCY.

THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: Pursuant to Chapter 227 ORS and Ordinance No. 70-32 (City of
Tigard Zoning Ordinance of 1970), the following amendment to ?
that ordinance, in conformance with prescribed procedures, was heard in
public hearing by the Tigard Planning Commission on September 20, 1977, and
the Planning Commission thereafter recommended to the City Council that the
zoning ordinance be amended as set forth in Section 4 below.
Section 2: The City Council finds that after due and legal notice, a
public hearing was held by the City Council October 24, 1977,
and that at that meeting all interested persons were afforded an opportunity
to be heard and present and rebut evidence with respect to said amendment.
Section 3: The City Council further finds that in conformance with the
City's adopted Housing Plan it is desirable for residents of
the City to acquire ownership of the dwellings within which they reside.
This amendment would permit each one-half of a duplex unit to be owned by
the separate occupants.
Section 4: Therefore, Chapter 18.20.020, Single Family Residential zones
(R-7, R-10, R-15, R-30) is amended to read as follows:
"18.20.020 Conditional Uses (1) Duplex residential, with a minimum
lot of ten thousand square feet: one duplex per lot; or two single
family units with a minimum lot area of five thousand square feet
per unit. In the event it appears that it is not practical to divide
a legal lot into two lots of 5,000 square feet each, the planning
director may approve the division notwithstanding the fact that one
lot is less than 5,000 square feet, provided, however, that no such
lot shall be smaller than 4,250 square feet."
Section 5: Inasmuch as it is necessary for the peace, health, and safety
of the people of the City of Tigard that the foregoing change
become a permanent part of the City's records, an emergency is hereby
declared to exist, and this ordinance shall be effective upon its passage
by Council and approval by the Mayor.

three times by number and title only this 24th day of October, 1977.
