Ordinance No. 77-47 i CITY OF TIGARD, OREGON i ORDINANCE No. 77- 47 E 4 AN ORDINANCE CALLING A SPECIAL ELECTION TO BE HELD ON THE _ 12 DAY OF 5 JULY 1977, FOR THE PURPOSE OF SUBMITTING TO THE LEGAL VOTERS OF THE CITY THREE (3) MEASURES TO LEVY TAXES IN EXCESS OF THE TAX BASE FOR DESIGFATED ITEMS OF THE CITY'S OPERATIONAL BUDGET, FIXING AN EFFECTIVE DATE AND DECLARING AM EMERGENCY. '4 WHEREAS,. the budget for the City of Tigard for the year beginning July 1, 1977 and ending June 30, 1978 was duly approved by the Tigard Budget ; Committee at its meeting of May 3, 1977, after proceedings in accordance with Chapter 294 O.R.S. ; and f WHEREAS, a hearing by the City Council on the budget as approved by the Budget Committee, after due and legal notice, was held on the 16th day of June, 1977, whereat all interested persons were afforded an opportunity to appear and be heard for and against any item in the budget; and WHEREAS, the Council has determined that sufficient funds to operate the essential functions of the City of Tigard for the period July 1, 1977 to June 30, 1978, cannot be made available within the limits of the presently existing tax base of the City, and therefore it is necessary to submit the following propositions to the voters of the City at a special election called and held for that.purpose; and WHEREAS, of the total proposed Operational Budget tax levy for said period, $183,227 is,within the limitation of Section 11, Article XI, Oregon Constitution, and the sum of $144,594 is in excess of said limitation, it .is necessary to submit to the legal voters the questions hereinafter set forth; NOW, THEREFORE, THE CITY OF TIGARD ORDAINS AS FOLLOWS: ' SECTION 1: The budget for the year beginning July 1, 1977 and ending June 30, 1978, as heretofore adopted by the Budget Committee and as duly published and heard, a copy whereof being hereto attached and by reference made a part hereof, be, and the same is, hereby adopted. c SECTION 2: A special election is hereby called to be held in the City of Tigard on the 1.2 bh day of July 1977, between the hours of 8:00 A.M. -ad 8,00 P.M. 'ENDING °�!UNE:30, 1978,. THE. SUM OF $117,594 IN EXCESS OF THE TAX BASE OF THE CITY COMPUTED IN ACCORDANCE WITH SECTION 11, ARTICLE XI, OREGON CONSTITUTION? EXPLANATION'OF BALLOT QUESTION The purpose of this measure is to provide a portion of the funds necessary to continue the provision ,of existing Operational Budget services which include police, parks, streets, insect control and planning. If this measure is approved that portion of the operating budget to be wholly financed by local taxes for the tax year 1977-1978 will be $16,146 less than ;that portion of the operating budget wholly fin- anced by local taxes for the preceding year. If approved the estimated tax rate for this proposal is .46 cents per 1,000 assessed valuation. The estimated tax rate for all City services will be reduced from $1.42 per 1,000 assessed valuation to $1.18 per 1,000 assessed valuation. THREE YEAR SERIAL LEVY FOR YOUTH SERVICES PROPOSAL SHALL THE CITY OF TIGARD BE AUTHORIZED TO LEVY, IN BEHALF OF TIGARD COMMUNITY YOUTH SERVICES INCORPORATED, THE SUM OF $66,000 52. TO BE LEVIED SERIALLY FOR THREE YEARS BEGINNING JULY 1, 1977 AND ENDING JUNE 30, 1980 IN THE AMOUNT OF $22,000 PER YEAR, SAID SUM BEING WHOLLY IN EXCESS OF THE TAX BASE OF THE CITY AS COMPUTED IN ACCORDANCE WITH SECTION 11, ARTICLE XI, OREGON CONSTITUTION? EXPLANATION OF BALLOT QUESTION The purpose of this proposal is to provide $22,000 per year for each of 3 years to Tigard Community Youth Services Incorporated to defray a portion of the operational expenses of that organization. Tigard Community Youth Services provides a prevention program designed to keep youth out of the juvenile court system through intervention services which include counselling, job referral, parent education, big ]trethe.r and big sister programs, informational". seminars and crisis intervention. If this measure is approved, that portion of the operating budget to be financed wholly by local takes for the tax years 1977-78, 78-79, and 79-80 will be $17,000 greater than that portion of the operating budget financed by local taxes for the 1976-77 tax year. If approved, the estimated tax rate for 1977-78 will be 9 cents per $1,000 assessed valuation and„would reduce by an uncertain amount each year thereafter due to increased assessed valuations. AGED SERVICES LEVY PROPOSAL PROPOSAL SHALL THE CITY OF TIGARD BE AUTHORIZED TO LEVY IN BEHALF OF TIGARD 53. LOAVES AND FISHES INC., FOR AGED 'SERVICES PURPOSES FOR THE PERIOD BEGINNING JULY 1, 1977 AND ENDING JUNE 30, 1978 THE SUM OF $5,000 IN EXCESS OF THE TAX BASE OF THE CITY COMPUTED IN ACCORDANCE WITH SECTION 11, ARTICLE XI.,OREGON CONSTITUTION? EXPLAT?ATION OF BALLOT QUESTION The purpose of the proposal is to provide $5,000 to Tigard Loaves and Fishes to defray a portion of the operational costs of this organization which provides nutritional, transportation and other services to the aged. If this measure is approved that portion of the operating budget financed wholly by Tigard taxes for the tax year 1977-78 will be $3,000 greater than that portion of the operating budget financed wholly by Tigard taxes for the preceding year. if 'approved. the estimated tax rate will be 2 cents per 1,000 assessed valuation. NO ❑ I vote against the proposed levy. SECTION 5: The polling places in the precincts, designated on the attached Schedule "A" are hereby approved and adopted. SECTION 7: Members of the Election Board for each precinct shall be appointed by Resolution of the City Council and each such member shall take the oath prescribed by law to faithfully perform the duties of said offices. PAGE_4 - ORDINANCE No. 77-„lZ_ 4 b Few SECTION 8: In all respects the conduct of said election shall conform to the procedures established by law, except as herein modified, and the City Recorder be, and she is hereby, authorized and directed to notify the designees of their appointment to serve as election board members. The City Recorder be, and she is hereby, further authorized and directed to take such further action required to obtain poll books, and prepare or cause to have prepared ballots and other election materials as necessary to the proper conduct of said election, and to incur all needful and necessary expenses incident thereto. SECTION 9: The City Recorder be, and she is hereby, directed to give notice of said election and the foregoing proposals in the manner following: (a) By publishing a copy of this ordinance in full in one (1) issue of the Tigard Times within twenty (20) days immediately prior to the election. (b) By posting notices of said special election, one at each of the designated polling places in each of the precincts in the City not less than ten (10) days prior to the date of the lection and also by publish- ing notice in the Tigard Times, once each week for two consecutive weeks, the first of such publishings to be not less than ten (10) days prior to the date of election. SECTION 10: That inasmuch as it is necessary that the foregoing proposals, as hereinabove set forth, be submitted to the legal voters of the City with the least possible delay, and it is necessary for the peace, health and safety of the people of the City of Tigard that the election be held at the earliest possible date, an., emergency is hereby declared to exist, and this ordinance shall take effect upon its passage by-the Council and signature by the Mayor.
