2AN ORDINANCE AMENDING ORDINANCE No. 76-50 FOR THE PURPOSE OF REVISING EXHIBIT
"B" THEREOF TO PROVIDE FOR THE COLLECTION OF AN ADDITIONAL CHARGE IMPOSED BY
THE METROPOLITAN SERVICE DISTRICT. (GARBAGE FRANCHISE GRANTED TO MILLER'S
SANITARY SERVICE, INC.)
WHEREAS, the Metropolitan Service District has imposed a disposal fee
on all said waste delivered to disposal sites; and
WHEREAS, this additional governmental fee results in increased costs to
franchised solid waste haulers in Tigard, and
WHEREAS, franchised haulers have requested a rate increase to defray
these additional costs and the Metropolitan Service District has recommended that
these additional costs be passed through to the generators of solid waste and the
City Council finds that the absorption of these additional governmental charges
by the franchised haulers would be improper and unfair, and
WHEREAS, the franchised haulers have submitted data which documents
the additional cost resulting from the Metropolitan Service District fee;
NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF TIGARD THAT:
Section l: Exhibit "B" as adopted by Ordinance No. 76-50is hereby
amended as,per the attached Exhibit "B-1" which by this reference is made a
part hereof and the maximum authorized rates to be charged for solid waste
disposal services shall not exceed the rates specified in said attached
Exhibit "B-1".
Section 2 This ordinance shall become effective upon the 31st day
following passage and approval by the Tigard City Council.

* M.S.D. Surcharge in addition to base rates
A surcharge of $0.15 per can per month may be added to the monthly rates
established herein to defray the Metropolitdri_ Service District solid
waste disposal fee. For purposes of computing the M.S.D. surcharge, a one yard
containers• shall be deemed equivalent to 7 cans and drop boxes shall be
surcharge $0,25 per yard for loose material and $0.35 per yard for compacted
material.
