the boundaries of the City of Tigard, and a copy of said final order has been
filed tai th the City Recorder.
NOW, THEREFORE,
THE CITY OF 'TIGARD ORDAINS AS FOLLOWS:
Section L: That the final older of the Boundary C07-Mission adopted on the
12th day ofJanuary, 1972 a copy whereof is hereto
attached and by this reference r,�de a part hereof, be, and ILh0 same is, hereby
ratified, confirmed and adopted by reference to the same ]( CCal force and effect
as if set forth herein in full.
Section 2: That the boundaries of the city of Ti.r,ard be, and they are hereby,
changed to include the 1 ends as described in tile within order of the
Boundary Con unission, and the corporate limits of the City of Tigard are hereby
changed in conformity therewith.

Section 3: That the Recorder Cf the City of Tigard be, and she is hereby,
directed to forthwith file a cope of this ordinance, including a

FINAL ORDER
RE: BOUNDARY CHANGE PROPOSAL NO. 1027 - Annexation of territory j-
to the City of Tigard.
Proceedings on Proposal No. 1027 commenced upon receipt by the
Boundary Commission of a petition from property owners on December
15, 1976 requesting that certain property be annexed to the city.
The petition meets the requirements for initiatin a proposal set
forth in ORS 222. 170 and paragraph (a) Section (4� of ORS .199.490.
Upon receipt of the petition, the Boundary Commission published
and posted notice of the public hearing in accordance with ORS
199.463 and conducted a public hearing on the proposal on January
12, 1977. The Commission also caused a study to be made on this
proposal which considered economic, demographic and sociological
trends and projections and physical development of the land.
FINDINGS
1
On the basis of the public hearing and the study the Boundary
Commission found that:
1. The territory to be annexed is contiguous to the city and
contains 136.72 acres, 10 single family residences, some out-
buildings, a riding stable, the city's Cook Park, an estimated
population of 30 persons, and is evaluated at $445,300.
2. Two major property owners desire to have their property in the
city to avail themselves of city services which will facilitate
residential development. Several other property owners are
interested in future development within the city. A major
property in the area is the city's Cook Park and additional
city-owned land intended for eventual park expansion.
3. The territory is Urban on the Washington County Framework Plan.
The designation of Urban also applies with the recently adopted
CRAG Regional Framework Plan. The Tigard Community Plan
identifies the area as suitable for Urban Low Density Residential
which allows up to 4 units per acre. Planned Unit Developments
such as the one proposed by one major property owner in the
territory to be annexed are encouraged in this designation
according to the Tigard Community Plan.

4. The city has a 10-inch sewer line extending along the entire
northern edge of the territory (TL 301 within the area to be
annexed is already receiving service from the city) . Planning,
building inspection, parks, etc. will be available immediately
upon annexation. Water service is available from the Tigard
Water District which has an 8-inch line in SW 92nd and a 12-inch
line in Durham Rd. Fire protection is provided to the entire
area by Tualatin RFPD.
5. The city made a concerted effort to promote a more logical
annexation by contacting all surrounding property owners north
of the Tualatin River in Section 14 and the five property. owners
on the north side of Durham Rd. at 98th Ave. Those properties
included in the proposal which are not represented on the
petition for annexation wojld become islands in the city if
only those who signed were annexed.
6. The Washington County Planning Staff and Planning Commission
request that the proposed be deferred or denied "to allow further
planning in the area and correlation of city and county activities."
REASONS FOR DECISION
On the basis of the findings the Commission determined that:
1. Two major property owners within the territory desire city
services to facilitate development now and several other property
owners desire services for individual existing homes and/or
future development.
2. The territory is classified as Urban by both the Washington
County Framework Plan and the CRAG Regional Framework Plan. The
city's comprehensive plan identifies the area as suitable for
low density residential development and this is what is being
contemplated by several property owners.
3. Sewers and other municipal services are available immediately
upon annexation. This particularly includes parks since the
city's Cook Park is a part of the annexation proposal. Water
is immediately available from the Tigard Water District which
has an 8-inch line in SW 92nd and a 12-inch line in Durham Rd.
The Tualatin RFPD already serves the entire area including the
existing city.
4. The proposal is a logical boundary extension in the sense of
ORS 199.410 (2) because it includes territory which would be
islanded if the city had submitted a proposal including only
those parcels the owners of which signed the annexation petition.

On the basis of the findings and reasons listed above, the Boundary
Commission approved BOUNDARY CHANGE PROPOSAL NO. 1027 on January
12, 1977.
NOW THEREFORE IT IS ORDERED THAT the territory described in Appendix }
"A" and depicted on the attached map, be annexed to the City of
Tigard as of this date.
