ORDINANCE No. 76- 36
AN ORDINANCE PROVIDING FOR A SPECIAL CITY ELECTION TO BE HELD IN THE CITY OF
TIGARD, OREGON, ON NOVEMBER 2, 1976, IN CONNECTION WITH THE REGULAR GENERAL
STATE ELECTION, FOR THE PURPOSE OF SUBMITTING TO THE LEGAL VOTERS OF THE CITY
OF TIGARD, OREGON, THE QUESTION OF ESTABLISHING A NEW TAX BASE PURSUANT TO
SECTION 11, ARTICLE XI, CONSTITUTION OF THE STATE OF OREGON AND DECLARING AN
EMERGENCY.
WHEREAS, the Council of the City of Tigard has determined that
sufficient funds to properly operate the essential functions of the City of
Tigard cannot be made available within the limits of the presently existing

the City and that there should be submitted to the legal voters
of the City the question of establishing a new tax base in accordance with the
provisions of Section 11, Article XI, Oregon Constitution; and
WHEREAS, pursuant to Section 11, Article XI, Oregon Constitution,
it is necessary to submit such question of establishing a new tax base to the
legal voters of the City at the state-wide general election to be held on
November 2, 1976;
NOW, THEREFORE, THE CITY OF TIGARD DOES ORDAIN AS FOLLOWS:
Section 1: The Council finds that it is necessary and in the best interests
of the people of the City of Tigard that there be submitted to the
legal voters of the City at the regular state-wide general election to be held
on November 2, 1976, and as a part thereof, the proposition hereinafter stated
in accordance with Section 11, Article XI, Constitution of the State of Oregon.
Section 2: That there should be submitted to the legal voters of the City of
Tigard voting at each precinct, or part thereof, within the City E'
at the said general election of November 2, 1976, the following proposition
for which purpose the following ballot title, number and form in which the
question shall be printed upon the official ballot is presented:

TAX BASE PROPOSAL
Explanation of the Ballot Question:
This proposal is referred to the legal voters of the City of Tigard for the
reason that the amount of taxes that may be levied by the Council of the City,
of Tigard within the present tax base is insufficient to cover current programs
and activities, approved by the voters for fiscal year 1976-77, during 1977-78-and.
future years. If approved, the total City tax levy will be 67 more than the
total tax levy already approved by the voters for this current year. The current
tax rate is $1.47 per $1,000 assessed valuation. `Phis proposal will result in
an estimated tax rate of $1.43 per $1,000 assessed valuation for the fiscal year
1977-78. This reduction in the tax rate is based upon an anticipated increase
in the total valuation of the city.

Section 3: The City Recorder is hereby authorized and directed to certify
in the manner provided by law to the Department of Records and
Elections of Washington County, the foregoing measure for inclusion as a part
of the regular ballot to be prepared by the Department of Records and Elections
for voting at all precincts within the City of Tigard at the statewide general
election of November 2, 1976.
Section 4: In all respects the conduct of the election on the tax base
proposition shall conform to the procedures established pursuant
to law for the conduct of the general election in said precincts and the polls
shall be opened at the same hour and closed at the same hour and all other
applicable provisions in accordance with the election laws of the State of Oregon
shall be respected.
Section 5: Notice of the City tax base proposal in form substantially as herein-
after set forth shall be given by three weekly publications in the
Tigard Times on October 14, 21, 28,;:1976, and by posting notice substantially
in the following form in the following designated places, such posting be
accomplished not later than October 18, 1976.
(a) At the front door of the City Hall exposed to public
view, Main Street, Tigard, Oregon.
(b) In one public place in each voting preci.nct, or part
thereof, within the City.
(c) At each polling place.
The City Recorder is directed to cause to have published and posted said notices
and shall file in the records of the City, an affidavit of posting in usual
form prior to October 23, 1976.
The form of notice shall be substantially as follows:

Notice is hereby given that pursuant to Ordinance No. 76-.Yt�
enacted by the City Council of Tigard on August 23, 1976,
at the State of Oregon General election of November 2,
1976, between the hours of 8:00 o'clock A.M. and 8:00
o'clock P.M. at each precinct within the City of Tigard,
there will be submitted to the legal voters of the City of
Tigard for their approval or rejection a tax base proposal
as set forth in the following facsimile sample ballot:

a new tax base for the City of Tigard pursuant to
Section 11, Article XI, Oregon Constitution. The

Section 6: It is necessary for the preservation of the public peace, health
and safety of the people of the City of Tigard that this
ordinance take effect immediately in order that the tax base proposal may be
properly submitted to the people of the City of Tigard at the state-wide °
I general election of November 2, 1976, and an emergency is hereby declared to
exist and this ordinance shall be effective upon its passage by the Council .
