ORDINANCE NO, 76-
AN ORDINANCE AMENDING THE TIGARD MUNICIPAL CODE BY THE ADDITION
OF SECTION 7.32.125 RELATING TO CARRYING OF LOADED FIREAWIS.
THE CITY OF TIGARD ORDAINS AS FOLLOWS !
Section 1: The Tigard Municipal Code is hereby amended by the
additicn of Section 7.32.125 as follows:
Carrying loaded firearms. As used in this section the
term "firearm" means a pistol, revolver, gun, rifle, or
other mechanism, including a miniature weapon, which projects
a missile or shot by force of gunpowder or any other explosive,
or by spring or by compressed air.
(a) It is unlawful for any person on a public
street: or in a public place to carry a firearm upon
his person, or in a vehicle under his control or in
which he is an occupant, unless all the ammunition
has been removed from the chamber and from the cylinder,
clip or magazine.
(b) It is unlawful for any person carrying a
firearm upon his person or in a vehicle under his
control or which he is an occupant, to refuse to ,
permit a peace officer to inspect that firearm after
the peace officer has identified himself as such.
(c) The provisions of subsections (a) and (b)
of this section do not apply to a peace officer, to
any governmental employee authorized or required by
his employment to carry or use a firearm, or to any
one justified in using deadly physical force under the
Provisions of O' c 161.195 to 161 275.
(d) Notwithstanding the provisions of subsections '
(a) , (b) , and (c) of this section, permits shall be issued '
by the police department of the city of Tigard authorizing y
uniformed private security personnel to carry unconcealed
firearms while performing the duties for which they are
employed. Such permits shall be issued upon application
to the Tigard Police Department and upon payment of an

initial $5 fee and a fee of $3 for annual renewal, and
such permit shall be valid for the period of one year
from the date of issuance. Permits issued pursuant to
this subsection shall be carried on the person of the
permitee whenever he or she carries a loaded firearm.
(e) Violation of any portion of subsections (a),
(b), and (d) is a class A misdemeanor.
Section 2: The Council finds that an emergency, exists. This
ordinance shall be effective on its passage and approval
by the Mayor.
