Ordinance No. 76-16 t ✓I CITY OF TIGARD, OREGON ORDINANCE No. 76 - /, AN ORDINANCE AMENDING THE TIGARD MUNICIPAL CODE, CHAPTER 18.60, OFF- STREET PARKING AND LOADING, TO ESTABLISH UPDATED OFF-STREET PARKING STANDARDS WHICH INCLUDE THE DIMENSIONS OF MANEUVERING AREAS AND PARK- ING STALLS AND THE NUMBER OF PARKING STALLS REQUIRED FOR EACH LAND USE CATEGORY; PRESCRIBING AN EFFECTIVE DATE AND DECLARING AN EMERGENCY. THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: Finding that pursuant to Chapter 227 of the Oregon Revised Statutes and Ordinance No. 70-32 (City of Tigard Zoning Ordinance of 1970), codified as Chapter 18, Tigard Municipal Code, the hereinafter stated amendments to sai..d zoning ordinance, pursuant to prescribed procedures, were heard in a public hearing held by the Tigard Planning Commission on February 17, 1976, and 7111 interested persons were there and then afforded an opportunity to be heard and there- after the Planning Commission recommended that said zoning ordinance, as codified, be amended as hereinafter set forth; and, further finding that, after due and legal notice, a public hearing was held before the City Council on March 29, 1976, whereat all interested persons de- siring to be heard were afforded an opportunity to be heard and pre- sent and rebut evidence with respect to said amendment; and, further finding that, based on evidence both oral and documentary, and on the .record of that hearing before the Planning Commission, the Council has made the following substantive findings. Section 2: Finding that the purpose for these amendments is to pro- tect the public health, safety and general welfare; and, further finding that these amendments are necessary to ensure that adequate off-street parking, is provided for land developments in order not to produce traffic congestion on the public streets and to protect the public health, safety and general welfare; Section 3: THAT THEREFOR, 18.60.010 Definitions. (a) : as now reads: "Except as other- wise defined in this code, 'one space' means a minimum area available forparkingnine feet wide and twenty feet long. No area shall be considered as a parking space unless the plans submitted shall show that the area is accessible and usable for that purpose." shall be amended to read: 1118.60.010 Definitions. (a) Except as otherwise defined in this code, one space means a minimum area available for parking nine feet six inches wide and nineteen feet long. No area may be considered as a parking space unless accessible and usable for that purpose." x t 18.60.120 Minimums ace requirements: as now reads: "Off- s reet parking shall be provided according to the following standards and regardless of the zone in which the use is located. (1) RESIDENTIAL USES: (A) Single family residences, one space for each dwelling unit; (B) Two family dwellings, one space for each dwelling unit; (C) Apartment dwelling, three spaces for each two dwelling units; (D) Residential hotel, rooming or boarding house, one space for each guest accommodation; (E) Fraterrii y or sorority houses, one space for each two occupants; (F) Hotel, one space for each guest room, plus one space for each two employees; (G) Motel or tourist court, one space for each guest room or suite, plus one space for each two employees; (H) Club: clubs shall be treated as combinations of uses such as hotel, restaurant, auditorium, etc. and the required spaces for each separate use shall be pro- vided; (1) Day nursery (children), one space for every four children, plus one space for each employee (2) INSTITUTIONS: (A) Convalescent homes; institutions for the aged; in- stitutions for children; welfare or correction in- stitutions (full time care) , a minimum of four spaces per use; in addition', one space for each five beds for patients, plus" one additional space for each two employees; (B) Hospitals, a minimum of six spaces per hospital, in addition, one space for each two beds, including bassinettes, plus one additional space for each two employees; .; (3) PUBLIC ASSEMBLY: (A) Church, a minimum of six spaces per church, in addition, one for each six seats or twelve feet of bench length; -2- Ordinance No. 16-- ��k (B) Library, one space for each four hundred square feet of gross floor area, plus one space for each two employees; (C) Auditorium or meeting rooms, except schools, a minimum of six spaces per assembly, in addition, ■ one space for each six seats or twelve feet of bench length; (D) College, commercial, one space for each six seats - in classrooms, plus one space for each two employees; (E) Nursery schools, elementary or high schools, two spaces per teacher; minimum of eight spaces per school, in addition, one space for each twelve seats or twenty-four feet of bench length in the audi- torium or assembly room or, if none, the sum of the classroom seating capacity, plus one space for each two employees; (F) Passenger terminal (bus, air or rail), one space for each five hundred square feet of gross floor area, plus one space for each two employees; (4) SPORTS .AND COMMERCIAL AMUSEMENT: (A) Stadium or race track, one space for each four seats or eight feet of 'bench length; (B) Indoor arena or theater, one space for each four seats or eight feet of bench length; (C) Bowling alley, five spaces for each alley, plus one space for each two employees; (D) Dance hall or skating rink, one space for each one hundred square feet of gross floor area, plus one space for each two employees; (E) Amusement park, one space for each one thousand square feet of gross area, plus one space for each two employees; (5) COMMERCIAL T (A) Retail stores including restaurant, cafe, tavern, night .club, but other than in subparagraph (B) below, minimum three spaces per use and, in addition, one space for each five hundred square feet gross floor area; plus one space for each two employees; �M t�. = (B) Service or repair shop and retail store handling bulky merchandise, such as automobiles and furniture, minimum three spaces per use and, in addition, one space for each five hundred sq. ft. of, gross floor area, plus one space for each two employees; -3- Ordinance No. 76- (C) Commercial or professional office space, one space per five hundred square feet of floor area, plus one space for each establishment, plus one space foreach two employees; (6) INDUSTRIAL: (A) Wholesale or freight terminal (water, air, rail or trucking) , one space for each employee on the largest shift; (B) Storage, one space for each employee on the largest shift; (C) Manufacturing or processing, one space for each employee on the largest shift; (7) Requirements for types of buildings and uses not specifically listed herein shall be determined by the planning commission, based upon the requirements of comparable uses listed. " shall be amended to read: 60 120 Minimum --Race rPnlirements. Off-street parking shall be provided according to the following standards, re- gardless of the zone in which the use, building, establish- ment or development is located. Any building, establishment or development may elect to define separate use areas which together total the gross floor area as defined in this code and apply these standards separately to those uses. TYPE OF USE PARKING SPACES REQUIRED (1) Residential (a) one or two-family 2 spaces per dwelling unit dwelling (may be tandem) (b) multi-family dwelling 1.5 spaces per dwelling unit (c) rooming or boarding 1 space for each guest room house plus 1 space for the owner (d) hotels, motels, motor 1 space for each guest room hotels, etc. plus 1 space for the owner (2) Institutional (a) convalescent, nursing 1 space per 2 beds and other health homes, sanitarium, rest home, home for the aged and other resident care facilities (b) hospital ij spaces per bed a, -4- Ordinance No. 76-1,6 C (3) Public and Semi-Public Buildings (a) auditorium or meeting 1 space for each 60 sq. ft. of room (other than gross floor area or where church or school) seating is fixed to the floor, one space for each 4 seats or 8 feet of bench length. (b) churches, clubs, 1 space for every 6 fixed seats lodges or every 12 ft. of bench length and/or every 100 sq. ft. gross floor area where no permanent seats are maintained.. (c) libraries, museums, 1 space for each 400 sq. ft. art galleries of gross floor area (d) pre-school, day nursery, 5 spaces plus 1 space per kindergarten classroom (e) elementary, junior high 10 spaces plus 1 space per school or equivalent classroom or 1 space per 4 private or parochial seats or 8 feet of bench school length in the auditorium, ,•.hichever is greater. (f) senior high and equi- 15 spaces plus 5 spaces per valent private or classroom or 1 space per 4 parochial school seats or 8 ft. of bench length in main auditorium, whichever is greater. (g) commuter type college 1 space for every full time equivalent student. (h) resident type college 1 space for every 3 full time equivalent students.
