Ordinance No. 76-10 CITY OF TIGARD, OREGON ORDINANCE NO, 76-3, AN ORDINANCE PROVIDING FOR PARKING RESTRICTIONS IN AREAS DESIGNATED AS "LOADING ZONES" ON THE PUBLIC STREETS OF THE CITY OF TIGARD; PRESCRIBING AN EFFECTIVE DATE. THE CITY OF TIGARD ORDAINS: Section 1:- -Chapter 10.28 of the Tigard municipal Code, relating to parking is hereby amended and supplemented by the addition of a new section, .to be designated 10.28.13.4 as follows: 10,28136 Loading Zones. (a) The City Council may establish loading zones along and street for the purpose of permitting the loading and unloading of merchandise and persons. The action of the City Council establishing such loading zones must be taken by ordinance. In establishing loading zones the City CoirCii, shall give consider-at-Jon o the;volume and nature of business within the area under consideration, the traffic demands upon the street in question, the nature of the need of the adjacent business or businesses and of the needs of other businesses within the immediate area, the width and surface of the street, and any other relevant infor- mation. In establishing loading zones the City Council may limit the applicability of the loading zone restric- tion to certain hours of the day or night. The charac- terization of the loading zone as an area of restricted parking shall be indicated by the placement of signs which shall indicate clearly the area affected, and which shall state the hours of the day during which. the "loading zone restriction applies. (b) Loading zones shall. be reserved for use by commercial vehicles in loading and unloading persons and commodities during the hours designated on all days except Sundays and Holidays. No person shall stop, stand or park any vehicle other than a commercial vehicle within the desig- nated area between such hours, except that noncommercial vehicles may use such zones while actually engaged in the loading or unloading of persons or commodities, but noncommercial vehicles shall upon demand give way to k commercial vehicles whose drivers desire to use the zone for loading or unloading purposes. Commercial vehicles using loading zones shall be entitled to the use of a loading zone only during such time as may reasonably be necessary for the loading and unloading of persons and materials and for so long as such activity shall actually continue. Loading zones shall not be used by employees of the business or busincoses fort-he benefit of which they were established, for any purpose except the continuous loading or unloading of persons or materials. (c) At all times other than those times designatedin the ordinance establishing a particular loading zone, such zones shall be available for general use under the parking regulations applicable to the district in which they are located. (d) The City Council will consider creation of loading zones upon application by any resident or property owner, and if, after consideration of the factors identified in (a) above, the City Council determines that a loading zone should be created, it shall create such loading zone e bs ordinance. and direct that the loading zone so estab- lished be marked by appropriate signs. The City shall procure appropriate signs and cause them to be installed. The applicant shall pay the City the cost of the necessary signs and poles and the cost of the labor necessary to install them, and installation shall not be made before such payment. ( Section _L: The following portions of public streets within the City of Tigard are hereby designated as loading zones for .the hours indicated: (1) Within the northeasterly half of S. W. Burnham Street from a point 15 feet southeasterly of the intersection of the northeasterly line of S. W. Burnham Street with the southeasterly line of S. W. Main Street, and extending Southeasterly to a point 45 feet from said intersection. The described portion of S. W. Burnham Street is hereby designated as a loading zone between the hours of 8 a.m. to 12 noon, Sundays and Holidays excluded. Section 3 : Section 10.28.110, subsection (a) , designating that portion of S. W. Burnham Street described in Section -2 CE ORDINANCE No. 76-_10,_ r r` r above as a 15-minute parking zone, is hereby repealed. Section This This ordinance shall become effective 30 days after its passage and approval by the City Council.
