6- ``"AN ORDINANCE AMENDING THE TIGARD MUNICIPAL CODE, CHAPTER 18.20, SINGLE
FAMILY RESIDENTIAL ZONES, TO INCREASE THE MINIMUM LOT SIZE REQUIRED
FOR A DUPLEX IN THE R-7 ZONE FROM 8,000 to 10,000 SQUARE FEET AND IN THE
R-13 ZONE TO DECREASE THE MAXIMUM LOT COVERAGE FROM 35 PERCENT TO 25
PERCENT; PRESCRIBING AN EFFECTIVE DATE AND DECLARING AN E1YIERGENCY.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: Finding that pursuant to Chapter 227 of the Oregon Revised
Statutes and Ordinance No. 70-32 (City of Tigard Zoning
Ordinance of 1970), codified as Chapter 18, Tigard Municipal Code, the
hereinafter stated amendments to said zoning ordinance, pursuant to
prescribed procedures, were heard in a public hearing held by the Tigard
Planning Commission on September 16, 1975, and all interested persons
were there and then afforded an opportunity to be heard and thereafter
the Planning Commission recommended that said zoning ordinance, as codi-
fied, be amended as hereinafter set forth; and, further finding that,
after due and legal notice, a public hearing was held before the City
Council on February 9, 1976, whereat all interested persons desiring to
be heard were afforded an opportunity to be heard and present and rebut
evidence with respect to said amendment; and, further finding that,
based on evidence both oral and documentary, and on the record of that
hearing before the Planning Cormission, the Council has made the follow-
ing substantive findings.
Section: 2: Finding that the purpose for these amendments is to pro-
tect the public health, safety and general welfare; and,
further finding that these amendments are necessary to Ensure the
right of Tigard's citizens to adequate light, air and open space and
to conform the single family residential zones to the objectives of the
Tigard Community Plan of 1971 and its amendatory Neighborhood Plans.
Section 3:, THAT THEREFOR,
Section 18.20.020 Conditional Uses, paragraph (1) , which now
reads
. . . (1) Duplex residential, with a minimum lot size of eight
thousand square feet: one duplex per lot;

shall be amended to read: P
... (1)Duplex residential, with a minimum lot size of ten
thousand square feet: one duplex per lot.

Section 18.20.030 Lot Size - R-7 Zone, paragraphs (1) and (2)
which now read:
.. .(1) The minimum lot area shall be seven thousand five hundred
square feet, ..
{. (2) The maximum lot coverage shall be thirty-five percent
shall be amended to read:
{
. . . (1) The minimum lot area shall be seven thousand five hundred
square feet, excepting for duplex use;
(2) The minimum lot area for duplex use shall be ten thousand
square feet. . .
(3) The maximum lot coverage shall be thirty-five percent of
the lot area.
Section 18.20.040 Lot Size - R-15 Zone, paragraph (2) , which now
reads:
. . . (2) The maximum lot coverage shall be thirty-five percent
shall be amended to read:
. . . (2) The maximum lot coverage shall be twenty-five percent.
Section 4: Inasmuch as it is necessary for the peace, health, and
safety of the people of the City of Tigard that the zoning
matters as hereinabove set forth be established with the least possible
delay, an emergency is hereby declared to exist and this ordinance shall
be effective upon its enactment by the Council and approval by the mayor.
PASSED: By UNANIMOUS vote of all Council members present, after
being read three times by number and title only, this
