AN ORDINANCE AMENDING THE TIGARD MUNICIPAL CODE, CHAPTER 18.92.060,
ADMINISTRATION, FEES; REMOVING THE ESTABLISHMENT OF FEES FROM THE ZONING j
ORDINANCE AND PRESCRIBING A PROCEDURE WHEREBY FEES WILL BE ESTABLISHED BY
COUNCIL AND DECLARING AN EMERGENCY.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: The City Council finds that pursuant to Chapter 227 ORS and
Tigard Ordinance No. 70-32 - "City of Tigard Zoning Ordinance
of 1970" - the hereinafter stated amendment to said zoning ordinance,
after due and legal notice, was submitted to public hearing by the Planning
Commission on October 7, 1975, and the Planning Commission thereafter
recommended to the City Council that said zoning ordinance be amended.
Section 2: The City Council further finds that,after due and legal notice,
a public hearing was held by the City Council on October 13,
1975, whereat all interested persons were afforded an opportunity to be
heard with respect thereto, and all other conditions precedent to amending
the zoning ordinance were fulfilled with respect to the following amend-
ment to the City's zoning ordinance.
Section 3: The Council further finds that the purpose for this amendment
is to protect the public health, safety and general welfare.
Section 4: That Chapter 18.92.060 be amended to read as follows: For the
purpose of partially defraying the expenses arising from or
incident to investigation, evaluation and processing ;of applications and
petitions, and the costs of public notices and hearings incident thereto,
fees are prescribed and required to be paid to the City at the time of
filing of applicable petitions and applications, as the case maybe. Said
- fees shall be prescribed by resolution of the City Council and shall be
available to all interested parties in the office of the City Planning
Department.
Section 5: Inasmuch as it is necessary for the public health, safety and
general welfare of the people of the City of Tigard that the
zoning matters as hereinabove set forth be established with the least
possible delay to thereby currently maintain the legislative, integrity of
the. City's zoning ordinances, an emergency is hereby declared to exist and
this ordinance shall be effective upon its enactment by the Council a-rid
approval by the mayor.
