ORDINANCE No. 75
AN ORDINANCE AMENDING THE TIGARD MUNICIPAL CODE, CHAPTER 17.50, FEES;
REMOVING THE ESTABLISHMENT OF FEES FROM THE SUBDIVISION ORDINANCE AND
PRESCRIBING A PROCEDURE WHEREBY FEES WILL BE ESTABLISHED BY COUNCIL AND
DECLARING AN EMERGENCY.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: The City Council finds that pursuant to Chapters 227 and 92

division Ordinance of 196811 - the -hereinafter stated amendment to said
subdivision ordinance, after due and legal notice, was submitted to public
hearing by the Planning Commission on October 7, 1975, and the Planning
Commission thereafter recommended to the City Council that said subdivision
ordinance be amended.
Section 2: The Council further finds that, after due and legal notice, a
public hearing was held by the City Council on October 13, 1975,
whereat all interested persons were afforded an opportunity to be beard
with respect thereto, and all other conditions precedent to amending the
subdivision ordinance were fulfilled with respect to the following amend-
ment to the City's subdivision ordinance.
Section 3: The Council further finds that the purpose for this amendment
is to protect the public health, safety and general welfare.
Section 4: That Chapter 17.50.010 be amended to read as follows: For the
purpose of partially defraying the expenses necessarily arising
from or incident to investigation, evaluation and processing of applications,
for subdivision, major partitioning, minor partitioning and variances, in-
cluding the cost of public notices and hearings incident thereto, fees are
prescribed and required to be paid to the City at the time of filing such
applications. The amount of said fees shall be prescribed by resolution
of the City Council, copies of which shall be available to all interested
parties in the office of the City Planning Department.
Section 5: Inasmuch as it is necessary for the health, safety and general
welfare of the people of the City of Tigard that the zoning
matters as hereinabove set forth be established with the least possible
delay to thereby currently maintain the legislative integrity of the
City's zoning, ordinances, an emergency is hereby declared to exist and
this ordinance shall be effective upon its enactment by the-Council-and
approval by the mayor.
