ORDINANCE No. 75 - J
AN ORDINANCE AMENDING COMPREHENSIVE PLAN MAP (NEIGHBORHOOD PLANNING
ORGANIZATION NUMBER ONE) WITH RESPECT TO REMOVING THE OPEN SPACE
DESIGNATION ON PROPERTY ABUTTING S. W. SCOFFINS STREET AND 490
FEET SOUTHEAST OF S. W. MAIN STREET, SAID OPEN SPACE COMPRISING
APPROXIMATELY TWO AND ONE HALF ACRES; AND FIXING AN EFFECTIVE DATE.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: The City Council finds Lljk L yt -'s nnccessary, expedient
and for the best interests of the people of the City of
Tigard that the Plan Map of Neighborhood Planning Organization Plan
Number One be revised so as to attain the purposes and objectives
of ORS Chapter 197 and ORS Chapter 227 insofar as applicable with
respect to the Ash Avenue-Downtown Planning Area.
Section 2: The Council further finds that amendment of the Neighbor-
hood Plan Number One Map is necessitated by changes which
have occurred affecting the subject property which, when the plan was
formulated, contained an operating school and adjoining playfields.
At the time of adoption, the City viewed the Fowler Junior High
School site as a potential location for a civic center; however,
this proposal was rejected by the voters and the potential for
public ownership and use of this site no longer exists. Therefore,
without the ability to acquire the property for public use, it is
no longer appropriate to designate it for open space use on the
Plan Map. The attached "Exhibit All depicts the removal of the open
space designation and its replacement by Retail-Commercial desig-
nation; this exhibit by reference is made a part herein.
Section 3: The Council further finds that pursuant to ORS 227.250
the Planning Commission, after due and legal notice, held
a public hearing in the Lecture Room of Twality Junior High School,
Tigard, Oregon, on July 15, 1975, where all interested persons were
given the opportunity to be heard. The report of this meeting being
forwarded to the City Council for their consideration on this matter.
Furthermore, after due and legal notice, a public hearing was held
in the Lecture Room of Fowler Junior High School, Tigard, Oregon,
on August ll, 1975, at 8:00 p.m. by the City Council, at which time
an oral presentation and pictorial display of the Plan was given,
and all interested persons were afforded an opportunity to be heard
with respect thereto and to comment thereon.
Section 4: This ordinance shall be effective on and after the 31st
day after its passage by the Council and approval by
the Mayor.
