AN ORDINANCE AMENDING THE TIGARD MUNICIPAL CODE, CHAPTER 18.40,
COMMERCIAL-PROFESSIONAL ZONE (C-P) WITH RESPECT TO CONDITIONAL USES
AND ALLOWABLE SIGNS; PRESCRIBING AN EFFECTIVE DATE AND DECLARING
AN EMERGENCY
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: The City Council finds that pursuant to Chapter 227 ORS
and Ordinance Nc 70-32 - "City of Tigard Zoning Ordin-
ance of 1970" - the hereinafter stated amendments to said zoning
ordinance, after due and legal notice, were submitted to publi(: hear-
ing by the City Planning Commission on May 6, 1975, and to the Coun-
cil thereafter recommended that said zoning ordinance be amended as
hereinafter set forth.
Section 2: The Council further finds that after due and legal notice
a public hearing was held by the City Council on July 14,
1975, whereat all interested persons were afforded an opportunity to
be heard with respect thereto, and conditions precedent fulfilled
ith respect to the following amendments to the City's zoning ordin-
ance.
Section 3: The Council further finds that the purpose for these amend-
ments is to protect the public health, safety and general
welfare; and furthermore, said amendments serve to implement the City's
objectives and policies concerning commercial development as stated
in the Tigard Community Plan.
Section 4: That Chapter 18.40, Commercial-Professional Zone (C-P), be
amended to read as follows: (underlining identifies addit-
ions):
18.40.011 Conditional uses. In this zone the following
uses and their accessory uses are permitted as conditional uses when
in accordance with the procedureal requirements of Chapter 18.84:
(1) Governmental structures or land uses;
(2) Lounges and night clubs;
(3) Medium rise apartment or office buildings (four
stories or above);
(4) Motels and hotes;
(5) Multi-family dwellings, subject to the regulations
and site restrictions of Ch, 18.2
(6) Restaurants;
(7 Theaters;
(8) Limited commercial uses if integrated within office-
park, including confectioneries, barber shops,
beauty shops, delicatessens, pharmacies, florist
shops, gift shops, shoe repair shops;
(9) Similar uses if approved by the Planni-ng Commission
(Ord. 72-67 §1, 1972).
18.40.070 Signs
1. (a) There shall be not more than one square foot of sign area
for each one hundred square feet of floor area within the
building or buildings to be identified. No sign shall ex-
ceed fifteen square feet in size unless approved under
paragraphs "Ct! or "F" below.

(b) No sign shall project above the roof line or extend over a
public sidewalk or right-of-way. All faces of signs shall
be parallel to the face of the building upon which the
sign is located and to which the sign pertains.
(c) Signs may be painted or otherwise applied directly to a
wall providing such sign is an integral part of building

(d) The sign may be lighted with indirect lighting. No neon
(exposed tubing), plastic (interior illumination), blink-
er, flashing or animated signs shall be permitted.

Section 6: Inasmuch as it is necessary for the peace, health and
safety of the people of the City of Tigard that the
zoning matters as hereinabove set forth be established with the
least possible delay to thereby currently maintain the legislative
integrity of the City's zoning ordinances, an emergency is hereby
declared to exist and this ordinance shall be effective upon its
enactment by the Council and approval by the mayor.
