AN ORDINANCE ABOLISHING THE BOARD OF APPEALS AS HERETOFORE ESTAB-
LISHED PURSUANT TO SECTION 204 OF THE UNIFORM BUILDING CODE, AS
ADOPTED BY ORDINANCE NO. 74-34, CODIFIED AS CHAPTER 14.04 OF THE
TIGARD MUNICIPAL CODE; AND FIXING AN EFFECTIVE DATE.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: The City Council finds that Section 204 of the Uniform
Building Code, as adopted by Ordinance No. 74-34, and
codified as Chapter 14.04 of the Tigard Municipal Code, was amended
as of June, 1974, to make permissive and not mandatory the require-
ment that each municipality appoint a Board of Appeals to determine
the suitability of alternate materials and method of construction,
and to provide for reasonable interpretations of the provisions of
the Code.
Section 2: The City Council further finds that the ftuictions to be
performed by the pre-existing Board of Appeals have been
substantially superseded by the ready availability of advice and
guidance as and when necessary from the state level pursuant to the
provisions of the State of Oregon Structural Specialty Code and Fire
and Life Safety Code.
Section 3: That the Board of Appeals heretofore established pur-
suant to Section 204 of the Uniform Building Code, as
adopted by Ordinance No. 74-34,: and codified as Chapter 14.04 of
the Tigard Municipal Code, be and the same is hereby abolished,
and the terms of offices of all members thereof be and the same
are hereby terminated, and all records and files of the said Board
shall bedeliveredto the custody of the City Recorder.
Section 4: This Ordinance shall be effective on the 31st day after
its passage by the Council and signature of the Mayor.
