ORDINANCE No. 75- 22
AN ORDINANCE AMENDING COMPREHENSIVE PLAN TEXT (NEIGHBORHOOD PLANNING
ORGANIZATION NUMBER ONE) WITH RESPECT TO THE APPROPRIATE LAND USES TO
BE LOCATED ON THAT PORTION OF PACIFIC HIGHWAY TRAVERSING THE NEIGHBOR-
€ HOOD, AND SPECIFYING THAT THE C-3, GENERAL COMMERCIAL ZONE, BE USED TO
IMPLEMENT THE PLAN'S POLICIES AND OBJECTIVES; AND FIXING AN EFFECTIVE
DATE.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section is 'rhe City COUILCil finds that it is necessary, expedient and
for the best interests of the people of the City of Tigard
that the Plan text of.Neighborhood Planning Organization Plan Number One
be revised so as to attain the purposes and objectives of ORS Chapter
197 and ORS Chapter 227 insofar as applicable with respect to the Ash
Avenue-Downtown Planning area.
Section 2: The Council further find that pursuant to Ordinance No.
75-16 that the following text change of the Neighborhood
Planning Organization Plan Number One be so specified to meet the intent
of the Council's action when adopting the Plan-
On page 24A delete the last paragraph and replace with the
following:
"The zoning of that portion on lands abutting on Pacific Highway
traversing the Neighborhood is proposed to remain C-3, General
Commercial zone, with the above-stated preference for types
and locations of land uses providing policy direction for
businesses wishing to locate on land abutting on highway and to
be used by the Planning Commission and Council when considering
permits and land partitionings."
Section 3: The City Council further finds that after due and legal
notice a public hearing was held at the lecture room of the
Fowler Junior High School, Tigard, Oregon, on Monday, April 28, 1975,
at 8:00 P.M. by the City Council whereat an oral presentation and pictorial
display of facts was given by the Planning Director and all interested
persons were afforded an opportunity to be heard with respect thereto and
to comment thereon.
Section 4: The Council further finds that Neighborhood Planning Organization
Number One, at a meeting of April 10, 1975, was presented and gave
due consideration to the revised text change of Neighborhood Planning
Organization Plan Number One with respect to the Ash Avenue-Downtown Area as
pertaining to the appropriate land uses to be located on that portion of Pacific
Highway traversing the neighborhood and specifying that the C-3 General
Commercial zone be used to implement the Plan's policies and objectives.
Section 5: This ordinance shall be effective on and after the 31st day
after its passage by the Council and approval by the mayor,
