ORDINANCE; NO. 74 -
AN ORDINANCE AUTHORIZING, APPROVING AND REFERRING TO THE VOTERS
PROPOSED AMENDMENTS 'PO THE CHARTER OF THE CITY OF TIGARD AS
IZRETOFORE AMENDED AS FOLLOWS:
(a) Amendinf; Section 12 of Chapter III with respect to
qualifications of officers;
(b) Amending Section 31 of Chapter VI with respect to
qualifications of nominees for elective city office;
CALLING A SPECIAL ELECTION TO BE HELD ON SEPTEMBER 3, 1974, FOR THE
PURPOSE OF SUBMITTING TO THE VOTERS OF THE CITY SAID PROPOSED CHART-
ER AMENDMENTS, FIXING AN EFFECTIVE DATE AND DECLARING AN EMERGENCY.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: That Section 12 of Chapter III of the Charter of the
City of Tigard as adopted by the voters on November 6,
1962, and as heretofore amended, be and the same is hereby amended
to read as fellows:
"Section 12. QUALIFICATIONS OF OFFICERS. A qualified
elector within the meaning of the State
Constitution, who will have resided cio�nmti m}ous for a
period of twelve (12) months or more,/ �c fli ., elec-
tion in an area which is within the corporate boundaries
of the City as the same shall existas ,opf a date one

the election, (inclusive of all territory previously
effectively annexed to the City), shall be eligible for
an elective office of the City. The Council shall be
final judge of the qualifications and election of its
own members, subject, however, to review by a court of
competent jurisdiction."
Section 2: That there shall be submitted to the legal voters of
the City at the election for which provision is here-
inafter made, the foregoing proposition set forth in Section 1
hereof, for which purpose the following ballot title and the form
in which the question shall he printed upon the official ballot,
is prescribed:

Section 3: That Section 31 of Chapter VI of the Charter of the City
of Tigard as adopted by the voters on November 6, 1962,
and as heretofore amended be and the same is hereby amended to read

"Section 31. NOMINATIONS. A qualified elector within

an elective City position. Nomination shall be by peti-
tion specifying the position sought in a form prescribed
by the council. Such petition --hall be signed by not
fewer than 25 electors. No elector shall sign more than
one petition for each vacant position. If he does so,
his signatures shall be invalid. The signatures to a
nomination petition reed not all be appended to one
paper, but to each separate paper of the petition shall
be attached an affidavit of the circulator thereof, in-
dicating the number of signers of the paper and stating
that each signature appended thereto was :iiade in his
presence and is the genuine signature of the person
whose name it purports to be. Edith each signature
shall be stated the signer's place of residence, iden-
tified by its street and number or other sufficient
description.
"All nomination papers comprising a petition shall be
assembled and filed with the recorder as one instrument
not earlier than 120 nor later than 90 days before the
election. The recorder shall make a record of the exact
time at which each petition is filed and shall take and
preserve the name and address of the person by whom it
is filed. If the petition is not signed by the required
number of qualified electors, the recorder shall notify
the candidate and the person who filed the petition
within five days after the filing. If the petition is
insufficient in any other particular, the recorder shall
return it immediately to the person who filed it, certify-
ing in writing wherein the petition is insufficient_ Such
de.f.icient petition may be amended and filed again as a new
petition, or a substitute petition for the same candidate
may be filed, within the regular time for filing nomina-
tion petitions. The recorder shall notify an eligible
person of his nomination, and such person shall file with
the ,. evtance of nomination, in such
the recorder his written a.,c....=_-_--
form as the council may require, within five days of
notification of nomination. Upon receipt of such acceptance
of nomination, the recorder ,hall cause the nominee's name
to be printed on the ballots. The petition of nomination
for a successful candidate at an election shall be pre-
served in the office of the recorder until the term of
office for which the candidate is elected expires." j
Section 4: That there shall be submitted to the legal voters of

Section 5: That a special election is hereby called to be held
in the City of Tigard on the 3rd day of September,
1974, for the purpose of submitting to the legal voters of the
City the foreging proposed charter amendments for approval or
rejection.
Section 6: In all respects the conduct of the said election
shall conform to the procedures established by law
for the conduct of primary elections, except as hereby modified,
and the polling place shall be the/F&Per Jr. High School Building
on Main Street, in the City of Tigard, Oregon, whereat the polls
shall open at 8:00 o'clock A.M. and remain open until 8:00 o'clock
P.M., Pacific Daylight Time, when the same shall be closed. The
City Recorder be and she is hereby authorized and directed to
notify the following named electors of each of their appointments
to serve as a member of the election board to conduct said election:

Section 7: The City Recorder be and she is hereby directed to give
notice of the proposed charter amendments substantially
in the form hereto attached, denoted Exhibit "A", and by this ref-
erence made a part hereof, by publication in the Tigard Tidies, on
August 18 , and August 25 , 1974, and by posting a copy of
the following designated nl

(a) At the front door of the City Hall exposed to pub-
lic view, Main Street, Tigard, Oregon;
�r (b) At the front door of the Community Hall on Commer-

Street, in Tigard, Oregon;
(d) At the polling place, to-wit: 0ld Fowler Jr. High
School, on Main Street, in Tigard, Oregon,
and shall file in the records of said election an affidavit of
posting in usual form.

Section 8: Inasmuch as it is necessary for the preservation of
the public peace, health and safety of the people
of the City of Tigard that this ordinance take effect immediately
in order that the proposed charter amendments may be properly
submitted to the voters of the City at the election on September
3, 1974, an emergency is hereby declared to exist and this ordi-
nance shall take effect immediately upon its passage by the Council
and approval by the Mayor.
