AN ORDINANCE AIENDING Chapter 16.32 OF THE T.I.GARD MU,4ICIPAL
CODE, ABOLISHING BOARD OF SIGN AI PEALS, TRAITSFERRING APPEAL FUNCTIONS
TO THE PLANNING COMMISSION AND AUTHORIZING THE COIflMISSION TO SO ACT;
PRESCRIBING EFFECTIVE DATE AND DECLARI!G AI•? rMERGENCY.
THE CITY OF TIGARD ORDAINS AS FULLOINS:

hereby amendedtoread as follows:
"15.32.010 That the board of sign appeals as provided. by
Section 16.32.010 be, and the same is,hereby
abolished."
Section 2: That Sections 16.32.020, 16.32.030 and 16.32.040
of the Tigard Municipal Code be, and they are, hereby
repealed.
Section 3: That Title 16 of the Tigard Municipal Code be, and the
same is hereby, amended to add thereto Chapter 16.34
entitled "APPEALS TO THE PLANNING COM'NISSION" with sections thereof
as follows:
"16.34.010 Right of appeal. Any person who has been ordered
by e u ing o cial to remove a ;>ign, whose application
for a permit or license pursuant to this title has been re-
fused, or whose permit has been revoked, may appeal to the
city planning commission. Such appeal shall not stay any
action directed by the building official in any case where
the building official determines that immediate action is
necessary due to an unsafe condition of a sign creating an
immediate hazard or danger to the public.
"Any appeal to the planning commission shall be filed
within 30 days after the final determination of the build-
ing official from which the appeal is taken. The planning
commission shall hear the appeal and make its determination
within 30 days after filing of the appeal. All decisions
of the planning commission with respect to matters under
this chapter shall be reported to the city council."
"16.34.020 Variance Tranting. The planning commission may
grant a variance Trom the provisions of this title based on
findings that due to practical difficulties, undue hardships
or i:iconsistencies with the objectives of this Title 16,
the strict or literal interpretation and enforcement of a
specific requirement hereunder should be waived or modified."
"16.34.030 Right of further appeal to city council. Any
decis on o- t e planning commission pursuan- i;`o`thTs title
may be appealed to the city council. Such appeal to the
council shall be in writing and shall be filed within 10
days after the final determination of the planning commis-
sion from which the appeal is taken. The council may

determine the matter de novo on the record or may set the
matter for hearing at a regular council meeting, and in

taken by the planning commission with respect to the matter
under appeal,"
Section 4: Inasmuch as the board of sign appeals heretofore estab-
lished is not now functioning as such, and it is nec-
essary for the peace, health and safety of the people of the City
of Tigard that provision be made for the handling of appeals with
respect to matters within the purview of Title 16 of the Tigard Mun-
ic1pal Code, an emergency iss herehv dpolared to exist, and this
ordinance shall be effective upon its passage by the Council anu
approval by the Mayor.
