AN ORDINANCE RATIFYING, CONFIRMING AND RECORDING CHANGE
IN THE BOUNDARIES OF THE CITY OF TIGARD BY THE BOUNDARY COMMISSZON,
ORDER No. 634 , INVOLVING LANDS OF Webber-Reinhart in Section 36,
Township 1 s7onth, Range 1 West,'Willamette Meridian,
WASHINGTON COUNTY, OREGOU, RECORDING EFFECTIVE DATE, AND DECLARING
AN EMERGENCY
`WHEREAS, the Boundary Commission established pursuant to
Chapter 494 Oregon Laws of 1969 for the Portland Metropolitan Area,
by its final order dated Seoter�ber 19, LUZ proved the

Tigard, and a

Ciy Recorder;

Section 2: That the boundaries of the city of Tigard be, and they
Sze hereby, changed to include the lands as described

limits of the City of Tigard are hereby changed- in conformity
therewith.
Section 3: That the Recorder of the City of Tigard be, and she
is hereby, -directed to forthwith file a copy of this
ordinance, including a copy of said Order, in the following

Section 4: That the City planning Commission be, and it is hereby,
authorized and directed to conduct such proceedings as
may be necessary to conform the authorized zoning and land use of
the described premises to the requirements of the City's Zoning a
Map and Code.
Section 5: Inasmuch as it is necessary for the peace, healt), and 1
safety of. the people of the City .of Tigard that the
foregoing change in the boundaries of the City become a permanent
part of the 'City's records, an emergency is hereby declared to
cxi=t, and this ordinance shall be effective upon its passage by
the council, and approval by the Mayor_

Legal Description
Beginning at the stone with a cross at the Northeast corner of the
George Richardson D.L.C. No. 55 in Section 36, 'Township 1 South,
Range 1 West of the W.M., in Washington County, Oregon; thence North
89° 00' vest 816.7 feet along the North line of said DLC to a 1 /4"v3"
strap iron; thence South 0029' West 450.5 feet, more or less, to a 1"
iron pipe in a fence line; thence South 8900' East 160.0 feet to a
1/2" iron pipe at the true point of beginning of the tract herein
described; thence South 0° 29' West 593.54 feet to an iron pipe in
the North right of way line of the Wnst Side Pacific Highway; thence
North 5,1002" East 238.70 feet along said right of way line to a lit"

1'r0c:C0din9s on Proposal No. 634 commenced upon receipt by the I1oundary
Conlaissi.on of a petition from property owners on August 15, 1973 re-
�. questing that the property described above be annexed to the City.
The petition meets the requirements for initiating a proposal set
'l h c �
forth in 01ZS 222 .170 and paragraph (a) Section (3) of Olt., 199.490.

Upon receipt of the petition the Boundary Commission published and f
posted notice of the public hearing in accordance with OlS 199. 463
and conducted a public hearing on the proposal on September 19, 1973 .
'1'hc Commission also caused a study to be made on this proposal which
considered economic, demographic and sociological trends and projec-
tions and physical development of the land.
on the basis of the public hearing and the study, the Boundary Com-
mission made a number of findings :
a) the territory to be annexed is contiguous to the City and
contains 1.89 acres , 2 commercial structures and is evaluated
at $112 ,300;
_b) the territory contains 2 commercial structures--one to be
demolished and one a newly constructed restaurant ;
c) .the restaurant owners wish to use the back portion of the '
two lots (beyon(I the depth of 200 feet) for parking;
d) the front 200 ft. of the territory is zoned. C-2 and the
back portions are zoned R-7 ;
c) Washington County's zoning ordinance will not allow the
back portion to be used for parking even though the
restaurant has very limited parking on the front 200 feet ;
the city's zoning ordinance would allow parking on the back
portions of the property ; and
t) the city can provide other municipal services
On the basis of the findings listed above, the Boundary Commission
�)�rproved BOUNDARY CHANGE PROPOSAL NO. 634 on September 19, 1973.
NOW THEREFORE IT IS ORDERED THAT the territory described above be
annexed to the Cit; of Tigard as of this date.
