AN ORDINANCE RATIFYING, CONFIRMING AND RECORDING CHANGE
IN THE BOUNDARIES OF THE CITY OF TIGARD BY THE BOUNDARY COMISSION.

AN EMERGENCY
WHEREAS, the Boundary Commission established pursuant to
Chapter 494 Oregon Laws of 1969 for the Portland Metropolitan Area,
by its final order drted February 7, 1973 approved the
hereinafter described change n the basin arses of the City of
Tigard, and a copy of said final order has been filed with the
V ity Recor ,dar.,
NOW THEREFORE,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section is That the final order of the Boundary Commission
adopted on the 7th day of February, 1973
a copy whereof is hereto attacTieW and by this reference made a
part hereof, be, and the sate is, hereby ratified, confirmed and
adopted by reference to the same legal force and effect as if
set forth herein in full.
Sention 2s That the boundaries of the City of Tigard be, and they
are hereby, changed to include the lands as described
in the within order of the Boundary Commission, and the corporate
limits of the City of Tigard r.,re hereby changed in conformity
therewith.`
fcti� o n 3s That the Recorder of the City of Tigard be, and she
is hereby, directed to forthwith file a copy of this
ordinance, including a copy of said Order, in the following
offices
(a) Secretary of State
(b) Department of Revenue and Taxation, Washington County
(c) Department of Records and Elections, Washington County
(d) Department of Public Works, Attention: Surveyor,
Washington County
Section 41 That the City Planning Commission be, and it is hereby,
authorized and directed to conduct such proceedings as
may ae_neceseary to vonfvrm the authorized zoning and land use of
the described premises to the requirements of the Cit 's Zoning
Map and Code: i

Section Ss5s inasmuch as it is necessary for the peace, health and
safety of the people of the City of Tigard that the
foregoing change in the boundaries of the City become a permanent
part of the City's records, an emergency is hereby declared to
// exist, and this ordinance shall be effective upon its passage by
the Council and approval by the Mayor.

FINAL ORDER
RE: BOUNDARY CHANGE PROPOSAL NO. 535 - Annexation of the follow-
ing territory to the City of Tigard
Legal Description
t That portion of land in the Northwest quarter of Section 11,
Township 2 South, Range 1 West, Willamette Meridian, Washington
County, Oregon, being more particularly described as follows:
Beginning at the Southwest corner of Tigardville Heights, a
subdivision of record in said County; said Southwest corner
Of Tigardville Heights being a stone in the West line of said
Section 11; running thence North, along the West boundary line
of said section, a distance of 818.73 feet to a point therein;
said point being the Southwest corner of that tract of land
conveyed to Douglas E. Johnson, et ux, by deed recorded in
Book 436, Page 21, Deed Records of Washington County; thence
continuing Northerly, along the West line of said section,
a distance of 376.81 feet to the Northwest corner of the
said Johnson tract of land; thence North 890 27' East, along
the North boundary line of the said Johnson tract of land and
along an Easterly extension thereof, a distance of 561.66 feet
to a point of intersection with the centerline of 40 foot
wide County Road No. 760 (S.W. 103rd Avenue) ; thence South,
along the centerline of said County Road No. 760, a distance
of 1202 feet, more or less, to an iron pipe in the South line
of said Tigardville Heights subdivision; said iron pipe in
the South line of Tigardville Heights subdivision also being
a point in the centerline of 40 foot wide S.W. Murdock Street;
thence Westerly, along the South line of said subdivision,
a distance of 61.66 feet to the point of beginning of this

description. Containing 15. 3 acres more or less.
Proceedings on Proposal No. 535 commenced upon receipt by the
Boundary Commission of a petition from property owners on December
12, 1972 requesting that certain property be annexed to the City.`
The petition meets the requirements for initiating a proposal set
_. forth in ORS 222.170 and paragraph (a) Section (3) of ORS 199.490.
Upon receipt of the petition the Boundary Commission.published and
posted notice of the public hearing in accordance with ORS 199.520
and conducted a public hearing on the proposal on February 7 , 1973.
.;. The Commission also caused a study to be made on this proposal which
considered economic, demographic and sociologicaltrends and -projec-
tions and physical development of the land.

On the basis of the public hearing and the study, the Boundary
} Commission made a number of findings :
a) the territory to be annexed is contiguous to the City
and the territory contains 15.3 acres, 2 single family
dwelling units, a water reservoir, a church and an esti-
mated population of 7 persons ;
b) the property owners request annexation to obtain City
services, particularly police protection, sanitary sewers
and land use and building code control;
c) new development proposed in the territory includes
expansion of the church and single family dwellings
and the proposed development is compatible with the
City's Comprehensive Plan; and
d) the City has an 8" sanitary sewer adjacent to the terri-
tory which can be extended to provide service to the
territory when development occurs.
On the basis of the findings listed above , the Boundary Commission
approved BOUNDARY CHANGE PROPOSAL NO. 535 on February 7 , 1973.
NOW THEREFORE IT IS ORDERED THAT the territory described above be
annexed to the City of Tigard as of this date.
