Ordinance No. 73-07 CITY OF TIGARD, OREGON ORDINANCE No. 73- AN ORDINANCE AMENDING ORDINANCE No, 72-66 PRESCRIBING PRO- CEDURES WITH RESPECT TO CONSIDERATION BY THE COUNCIL AND ALLOWANCE OF EXCEPTIONb TO A MORATORIUM ON THE CONSTRUCTION, PLACEMENT OR ALTERATION OF, OUTDOOR ADVERTISING SIGNS OR BILLBOARDS; FIXING AN EFFECTIVE DATE AND DECLARING AN EMERGENCY. THE CITY OF TIGARD ORDAINS AS FOLLOWS: Section 1: That Ordinance No. 72-66, as enacted by the Council on the 30th day of October, 1972, be, and the same is hereby amended and supplemented to add thereto a new section hereby desig- nated 3(a) reading as follows: nF1.Let2 eto Section vas .��.-„ - -follows: - "Section 3(a): The City Council may authorize exceptions to the moratorium imposed by this ordinance. Application for exceptions shall be filed with the City Recorder on a form prescribed for application for building permits. In addition to the other requirements of said form of application, the applicant shall submit in narrative form a statement of justification for the allowance of an exception to the moratorium, including but not re- stricted to a description of the special circumstances or conditions affecting the property or the applicant, with a further showing that the granting of an exception is necessary to avoid unusual, serious or extraordinary hardship upon the applicant, and further providing such additional information as the applicant may desire in support of the applicant's request, and to indicate that the allowance of the exception will not substantially interfere with, or impair, the attainment of the purposes of the moratorium as set forth in Ordinance No. 72-66 of which this section is a part. "Upon the filing of an application for such exception, a hearing shall be held by the City Council with respect thereto within the next thirty (30) days after the filing, and notice of the hearing shall be given by one (1) publication in the Tigard Times, a newspaper of general circulation in the City, within a week prior to the date of hearing.` "The decision of the City Council with respect to the granting or denial of the applicant's request for an exception wailbe „c ^a the applicant within . corp"�a:;�ica��.. five (5) days after such hearing." Section 2: Inasmuch as it is necessary for the peace, health, safety and welfare of the people or the City of Tigard that pro- vision be made forconsiderationby the City Council of petitions for exception to the moratorium imposed by Ordinance No.-72--66, an emer- gency is hereby declared to exist and this ordinance shall take effect / upon its,passage by the City Council snd approved by the Mayor.
