ORDINANCE NO.72-69
All ORDINANCE AMENDING Ordinance No.71-38 (as amended by Ordi-
nances Nos-72-3, 72-45 and 72-56) TO PRESCRIBE A NEW EFFECTIVE DATE
FOR THE TERMINATIO14 OF THE TEMPORARY I1ORATORIU14 ON ISSUANCE OF BUILD-
ING PERMITS WITHIN AN AREA SERVED BY AND LYING IdESTERLY OF S. W. GAARDE
AVENUE IN THE CITY OF TIGARD, AND TER1,1INATING SAID MORATORIUM AS OF
THE CLOSE OF BUSINESS ON NOVEMBER 20, 1972, PRESGRIBIN& EFFECTIVE DATE
AND DECLARING AN EMERGENCY.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: The Council finds that a program to over_:;.::_: the threat
and danger to the peace, health and safety of the people
of the area and the travelling public, which formed the basis for the
imposition of a moratorium on issuance of building permits as de-
scribed in Ordinance N0.71-38 (as amended by Ordinances Nos.72-3,
72-45 and 72-56), has now reached the action level and substantial
mitigation of the traffic congestion is an immediate prospect, and
therefore the moratorium on issuance of building permits thus imposed
should now be terminated.
Section 2: That Section 8 of Ordinance N0.71-38 be, and the same is,
hereby amended to read as follows:
"Section 8: That the City of Tigard does hereby declare a
temporary moratorium with respect to issuance of
building permits for new construction within that
portion of the City of Tigard lying tithin the area
described on the attached Exhibit "A", and no build-
ing permits for new construction within said area
shall be issued by the City of Tigard prior to
the close of business on November 20, 1972 EXCEPT as
hereinafter provided with respect to allowance of
appeals by the City Council."
Section 3: That Section 9 of Ordinance No,71--38 be, and the same is,
hereby, amended to read as follows.
"Section 9 That the moratorium shall be and remain in
effect until the close of business on November 20,
1972, or until such earlier date that the City
Council has determined that essential improvements
have been substantially aqeomplished consistent with
the Traffic Safety Program of Jure 28, 1971 with
respect to vehicular traffic in the area above de-
scribe(: xtd thereby the present and potential threat
and danger to the peace, health, safety and welfare
of the people of the --ea and the travelling public
have been substantially reduced and reasonably over-
come, provided that the Council may authorize excep-
t-ions to the moratorium as hereinafter provided."
Section 4: Inasmuch as it is necessary for the peace, health and
safety of the people of the City of'Tigard that termina-
tion of the moratorium for the issuance of building; permits as here
inabove set forth shall become effective with the least possible

delay, an emergency is hereby declared to exist, and this ordinance
shall become effective upon its passa;e by the Council and approval
of the Mayor.
PASSED: By unanimous vote of all Council members present, after
being read three times by number and title only,
this 20th day of November, 1972.
