Tigard, and a copy of said final order has been filed with the
City Recorder,
NOW THEREFORE,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section Is That the final order of the Boundary Commission
adopted on the 4th day of October, 1972
a copy whereof is hereto attached and by this reference made a
part hereof, be, and the same is, hereby ratified, confirmed and
adopted by reference to the same legal force and effect as if
Het forth herein in full.
Section 2: That the boundaries of the City of Tigard be, and they
are hereby, changed to include the lands as described
in the within order of the Boundary Commission, and the corporate
limits of the City of Tigard are hereby changed in conformity
therewith.
Section 3: That the Recorder of the City of Tigard be, and she
is hereby, directed to forthwith file a copy of this
ordinance, including z copy of said Order, in the following
offices:
(a) Secretary ofState
(b) Department of Revenue and Taxation, Washington County
(c) Department of Records and Elections, Washington County
(d) Department of Public works, Attention: Surveyor,
Washington'County
Section 4: ;That the City Planning Commission be, and it is hereby,
authorized and directed to conduct such proceedings as
may be necessary to conform the authorized zoning and landuseof
the described premises to the requirements of the City's Zoning
Map and Code.
Section 5: Inasmuch as it in necessary for the peace, health and
safety of the people of the City of Tigard that the
foregoing change in the boundaries of the City become a permanent
part of the'City's records, an emergency is hereby declared to
exist, and this ordinance'shall be effective uron its passage by
the Council, .and approval by the Mayor.

Proceedings on Proposal No. 447 commenced upon receipt by the Boundary
Commissio^ of a petition from property owners on June 15, 1972 request-
ing that the property described above be annexed to the City. The
petition meets the requirements for initiating a proposal set forth
in ORS 222.170 and paragraph (a) Section (3) of ORS 199.490.
Upon receipt of the petition the Boundary Commission published and
hearing in accordance with ORS 199.520 and
posted notice of the public
earing on the proposal on July 12, 1972. The

Commission also caused a study to be made on this proposal which con-
sidered economic, demographic and sociological trends and projections

On the basis of the public hearing and the study, the Boundary Commission
made a number of findings:
"Att a) the territory to be annexed is contiguous to the City and
contains approximately 201 acres , 5 single family residences,
and an estimated population of 15 persons;

4 b) the property owners petitioned to annex to obtain
. municipal services, particularly police protection,
local street maintenance and sweeping, sewer system
maintenance, building code administration, to facilitiate
development of the territory for residential purposes ;
c) the development is proposed as a mixed single family and
multi-family planned unit development containing no more
.` than 1250 dwelling units or 2 ,300 persons at full develop-
ment; the proposed development is compatible with the
County's land use regulations for the area (the County
granted a zone change on September 12 authorizing the
development) and is compatible with the City's areawide
comprehensive development plan;
d) the City of Tigard has the ability to provide the municipal
services requested by the property owners for the proposed
development; and
e) the boundary change almost creates an unincorporated "island"
area which prior to this proposal was surrounded on three
sides by the City's boundary; the boundary change is a
necessary step toward the building of a more viable general
purpose governmental unit in the Tigard community and is a
logical step toward the elimination of an already illogical
and uneconomical governmental boundary situation.
On the basis of the findings listed above, the Boundary Commission
approved BOUNDARY CHANGE PROPOSAL NO. 447 on October 4, 1972. _
NOW THEREFORE IT IS ORDERED THAT the territory described above be
annexed to the City of Tigard as of this date.
