AN ORDINANCE ADOPTING AND ENACTING A CODIFICATION OF THE
GENERAL ORDINANCES OF THE CITY OP' TIGARD, TO BE KNOWN AS THE "TIGARD
MUNICIPAL CODE OF 1972" AND PROVIDING THAT SAME MAY BE CITED AS SUCH
IN ALL PROCEEDINGS WITHIN THE PURVIEW THEREOF; PRESCRIBING THAT SAME
SHALL HAVE NO RETROACTIVE EFFECT WITH RESPECT TO PRE-EXISTING VIOLA-
TIONS OF ORDINANCES, DUTIES OR OBLIGATIONS; DECLARING THAT THE PRO-
VISIONS THEREOF SHALL BE SEVERABLE: PRESERVING THE INTEGRITY AND
APPLICABILITY OF PPE-EXISTING ORDINANCES IN THE EVENT OF DECLARATION
OF UNCONSTITUTIONALITY OF ANY SECTION OF THE CODE; AND PRESCRIBING
EFFECTIVE DATE.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: Adoption. The codification of general ordinances of the
City of Tigard as prepared and published by Book Publish-
ingCompany of Seattle, Washington, a bound copy thereof being hereto
attached and by reference made a part hereof, is hereby adopted and
enacted as the "TIGARD MUNICIPAL CODE OF 1972" and may be cited as
such in all proceedings within the purview thereof.
Section 2: Designations and References. In any prosecution for the
V olat on o any provisions of the Tigard Municipal Code,
or in any legal proceeding within the purview thereof, it shall be
sufficient to refer to the applicable title, chapter, section or
subsection of the Tigard Municipal Code, and all such references ahall
apply to the applicable numbered title, chapter, section or subsection
as It appears in the Tigard Municipal Code.
Any ordinance adding to, amending, correcting or repeal-
ing all or any portion of a sectirn of the Code shall refer to and
designate the applicable title, chapter, section or subsection of
the Tigard Municipal Code, and whenever reference is made to any
portion of the Code, the reference shall apply and be applicable to
amendments, corrections or additions heretofore or hereafter enacted
by the City of Tigard.
Section 3: Title ' Chapter and Section Headings. Title, chapter and

govern, limit, modify or in any manner affect the scope, meaning or
intent of the provisions of any title, chapter or section hereof.
Section 4: Reference to Specific Ordinances. The provisions of this

therein specifically designateby number or otherwise and which are

included within the Code, but such reference shall be construed to
apply to the corresponding provisions ;ontained within this Code.
Section 5: Effect of Code on Past Actions and Obligations. Neither

hereby of any ordinance or part or portion of any ordinance of the
City shall in any rianner affect the prosecution for violations of

ordinances, which violations were comznitted prior to the effective
date hereof, nor be construed as a waiver of any license, fee or
penalty at said effective date due and unpaid under such ordinances,
nor be construed as affecting any of the provisions of such ordinances
i relating to the collection of any such license, fee or penalty, on
the penal provisions applicable to any violation thereof, nor to
affect the validity of any bond or cash deposit in lieu thereof re-
quired to be posted, filed or deposited pursuant to any ordinance
and all rights and obligations thereunder appertaining shall continue
in full force and effect.
Section 6: Co_nstituti_onali . If any section, subsection, sentence,
clause or p rase of this code is for any reason held to
be invalid or unconstitutional, such decision shall not affect the
validity of the remaining portions of this code. The Council hereby
declares that it would have passed this Code, and each section, sub--
1 s tence r.lauss andphrase thereof, irrespective of the fact

that any one or more sections, subsections, sentences, clauses or
phrases had been declared invalid or unconstitutional, and if for any
reason this Code should be declared invalid or unconstitutional, then
the original ordinance or ordinances shall be in full force and effect.
Section 7: Effective Date. This ordinance, and the Tigard municipal
Uo e of 2, hereby adopted, shall be and shall become
effective on and after the 31st day of the adoption of this ordinance
by the Council and approval by the Mayor.
