AN ORDINANCE PROVIDING FOR A SPECIAL CITY ELECTION TO BE HELD IN
THE CITY OF TIGARD, OREGON NOVEMBER 7, 1972, IN CONNECTION WITH
THE GENERAL STATE ELECTION, FOR THE PURPOSE OF SUBMITTING TO THE
LEGAL VOTERS OF THE CITY OF TIGARD, OREGON, THE QUESTION OF
ESTABLISHING ANEW TAX BASE PURSUANT TO SECTION 11, ARTICLE XI,
�. CONSTITUTION OF THE STATE OF OREGON.
WHEREAS, the Council of the City of Tigard finds that
sufficient funds to properly operate the essential functions of
the City of Tigard cannot be made available within the limits of
the presently existing tax base of the City and that there should
be submitted to the legal voters of the City the question of es-
tablishing a new tax base in accordance with the provisions of
Section 11, Article XI, Oregon Constitution; and
WHEREAS, pursuant to Sectior. 11, Article XI, Oregon Consti-
tution, it is necessary to Submit such question of establishing a
near tax base to the legal voters of the City at the state-wide
general election to be held on November 7, 1972;
NOW,THEREFORE,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: That it is necessary and in the best interests of the
people of the City of Tigard that there be submitted to
the legal voters of the City at the regular state-wide geneziJ
election to be held throughout the state including all voting pre-
tincts within the City on November 7, 1972, the proposition herein-
after stated in accordance with Section 11, Article XI, Constitution
of the State of Oregon.
Section 2 That there shall be submitted to the legal voters of
the City of Tigard voting at each precinct, or part
thereof, within the City at the said general election of November 7,
1972, the following proposition for which purpose the following
ballot title, number and form in which the question shall be printed
upon the official ballot is prescribed:

For the reason that the amount of taxesthat may
be levied by the Council of the City of Tigard within
theppresent tax base of the City determined by Section
11, Article XI, Constitution of Oregon, is insufficient
to cover the increased costs of personal services,
maintenance and operation of essential city functions,
the following proposition is referred to the legal
voters:

Section:3: That the foregoing proposition shall be submitted to
the legal voters of the City of Tigard by separate
ballot at each precinct, or part thereof, in the City of Tigard,
at said general election of November 7, 1972, and the said election

with respect to said proposJ4.tion shall be conducted by the regular

election boards designated to conduct tt.e regular state-wide gen-
eral election in said precincts on Navember 7, 1972. Such election
boards regularly designated to coliduct said general election are
hereby designated as the election boards to conduct the Flection
with respect to the foregoing tax base proposal.
Section 4: In all respects the conduct of the election on the
tax base proposition shall conform to the procedures s`
established purs<aant to the law for the conduct of the general elec-
tion in said precincts and the polls shall be opened at the same hour
and closed at the same hour and all other applicable provisions in ,
accordance with the elections laws of the State of Oregon. @$
Section _5: Notice of the City tax base proposal in form substan-
tially as hereinafter set forth shall be given by three
weekly publications in the Tigard Times on October 19, 26 and
November 2, 1972 and by pasting notices substantially in the Follow-
ing form at each of the rollcwi^g designated places, such posting
to be accomplished not later than October 19, 1972;
(a) At the front door of the City Hall exposed
to public view, Main Street, Tigard, Oregon.
(b) In one public place in each voting precinct,
or part thereof, within the City.
The City Recorder is directed to cause to have published and posted
said notices and shall file in the records of said election an affi-
davit of posting in usual form prior to October 21, 1972.
The form of notice shall be substantially as follows:

Notice is hereby given that pursuant to Ordin-
ance No. 72- 60 enacted by the City Council of Tigard

of 8;00 o'clock A.NI. and 8.00 o'clock P.M. at each
precinct within the City of Tigard, there will be sub-
witted to the legal voters of the City of Tigard for g
their approval or rejection the following proposition:
For the reason that the amount of taxes that may
be levied by the Council of the City of Tigard within
the present tax base of the City determined by Sec-
tion 11, Article XI, Constitution of Oregon, is in-
sufficient to cover the increased costs of personal
services, maintenance and operation of essential city
functions, the following proposition is referred to
the legal voters:

The foregoing pproposition, if adopted, will establish a
new tax base for the City of Tigard pursuant to Section 11,
ArticleXt, Oregon Constitution. The pollingplaces in the
City of Tigard .for the purpoee of. submitting the foregoing
proposition will be the same as those designated for the
state-wide general election of November 7, 19720 and the
election will be conducted in all respects by the same elec-
tion boards as designated and appointed for the state-wide
general election.

Section 6: That the Council of the City of Tigard deems it unneces-
sary for the City of Tigard, or any officer thereof, to
furnish the legal voters of the city any tax hast, plertion pamphlets
containing the text of the proposition or arguments in support of or
in opposition to the proposition.
Section 7: The City Recorder be and she is hereby authorized and
directed to furnish to the Department of Records and
Election of Washington County. Oregon,, and to the extent required
by the Director of Records and Elections, L7aahington County, Oregon,
fLrnished to the election boards of eachprecinct of the City ballots,
ballot boxes and all necessary election materials and to take any
and all. other and further actions as may be required to give effect to
the previsions of this ordinance.
Section 8: It is necessary for the preservation of the public peace,
health and safety of the people of the Cit; of Tigard
this ordinance to take effect immediately in order that the tax base
proposal may be properly submitted to the people of the City of
Tigard at the state-wide general election of November 7, 1972, and
an emergency is hereby declared to exist and this ordinance shall be
effective upon its passage by the Council and signature by the Mayor.
PASSED: By the Council, by unanimous vote of all Council members
present, after being read three times by number and
