r AN ORDINANCE AMENDING ORDINANCE NO. 70-32 "CITY OF TIGARD ZONING [.
ORDINANCE OF 1.970" AS HERETOFORE AMENDED, CHANGING THE ZONING NAP OF
THE. CITY OF TIGARD, AND THE ZONING CLASSIFICATION OF A DESIGNATED AREA
FROM PRE-EXISTING ZONING CLASSIFICATIONS TO C-P CODSIF,RCIAL-PROFESSIONAL
TO THEREBY BRING SAID AREA INTO CONFORMITY WITH TIGARD COMIdUNITY PLAN
AS HERETOFORE ADOPTED BY THE CITY COUNCIL, PRESCRIBING AN EFFECTIVE l
DATE AND DECLARING All ENERGENCY
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: The City Council finds that pursuant to Tigard Community
Plan heretofore adopted by the City Council, the lands
hereinafter described were preliminarily classified and designated for
C-P Commercial Professional classification, and
Section 2: The Council further finds that pursuant to the provisions
of Ordinance No. 70-32, after due and legal notice, a public
hearing was duly and regularly held by the Tigard Planning Conunission
on August 15, 1972, whereat all interested persons and the general public
were afforded an opportunity to be heard with respect to rezoning of the
hereinafter described premises and that thereafter by unanimous vote the
City Planning Commission approved the proposed rezoning and recommended
the same to the City Council, and
section 3: The City Council further finds that after due and legal
notice a hearing was held by the City Council- on Monday,
the 11j1 day of September, 1972, whereat all interested persons and the
general public were afforded an opportunity to be heard and thereafter
said hearing was closed, and
Section 4: The City Council further finds that all proceedings with
respect to the subject matter hereof were conducted after
due and legal notice and in the manner provided by law, and
Section 5: - The City Council further finds that the proposed change in
the zoning map of the C1ty and the zoning classification of
the lands hereinafter described from their pre-existing classification
and uses to the C-P Commercial Professional zoning classification and the
uses permitted thereunder, is in the best interest and will promote the
.health, comfort, convenience, public order and public welfare to provide
adequate light, air, reasonable access, and recognize the peculiar suit-
ability of the lands for C-P Commercial Professional uses ar_d conserve
the property values.
Section 6: - That all lands situate within the following described
boundaries and the zoning, use and classification of all
thereof be, and the same are hereby,`rezoned and reclassified for use
in accordance with C-P Commercial Professional zone classification of
Ordinance No. 70-32,"City of Tigard Zoning Ordinance of 1970" as amended,
which ordinance with respect to Commercial-Professional classification
is by reference made a part hereof, said lands being described as
follows
ordinance No. 72 -S'
That portion of land in Section 1, Township 2 South,
Range 1 West, Willamette Meridian, Washington County, Oregon,
being more particularly described as follows- F
Blocks 37, 38 and 39 of West Portland Heights

Subdivision.

Section 7: That inasmuch as it is necessary in order to preserve €
the integrity of the zoning regulations applicable to ,
the hereinabove described lands and to provide for continuity of
zoning classification and control in accordance with the Tigard
Community Plan as adopted by the City Council it is delcared to be
in the public interest and necessary for the peace, health and
safety of the people of the City of Tigard that this ordinance
become effective with the least possible delay and, therefore,
an emergency is declared to exist and this ordinance shall be C
effective upon its passage by the Council and approval by the Mayor. r

PASSED: By unanimous vote of all Council members present,
after being read three times by number and title only,
this 9th day of October, 1972.
