ORDINANCE No.72- 42-
AN ORDIRANCE AMENDING Section 13, ARTICLE VI of Ordinance No.
72-21 - "POLICE CODE OF THE CITY OF TIGARD", BY ADDING THERETO SUB-
SECTIONS 1(a) and 1(b) PROVIDING THAT BRINGING OR ALLOWING CERTAIN
ANIMALS TO BE ON LANDS OF SCHOOI, DISTRICT #23J IMPROVED FOR SCHOOL
�•: PURPOSES AND THE USE, OPERATION OR RIDING OF MOTORIZED VEHICLES UPON
CERTAIN PORTIONS OF SITES OF SCHOOL, DISTRICT #23J IMPROVED FOR SCHOOL,
PURPOSES SHALL CONSTITUTE CRIMINAL TRESPASS; PRESCRIBING PENALTIES
AND DECLARING ABI EMERGENCY,
THE CITY OIC' TIGARD ORDAINS AS FOLLOWS:

Section 1: That Section 13, ARTICLE VI of Ordinance No. 72-21 -
"POLICE CODE OF THE CITY OF TIGARD", be, and the same is
hereby, aniended to include therein a new subsection denoted "Section
13 - ?(a), reading as follows:
"Section 13-1(a): A person commits the crime of criminal
trespass in the second degree if he permits, brings or
allows any horse,mule, donkey or other such animal, whether
or not attended, at any time on any site or lands of School
District #23J within the City of Tigard, improved for school
purposes."
Section 2: That Section 13, ARTICLE VI of Ordinance No. 72-21 -
"POLICE CODE OF THE CITY OF TIGARD", be, and the same is
hereby, amended to include therein a new subsection denoted "Section
13 1(b)11, reading as follows:
"Section 13-1(b) A person commits the crime of criminal
trespass in the second degree if he uses, operates or rides
upon any motorized vehicle on or within any lands of School
District #23J within the City of Tigard, improved for school
site purposes, other than on or within driveways, parking
areas and other areas specially designated for vehicular use,
unless directed to do so by the administrative officers of
the District."
Section 3: Violation of this ordinance shall constitute a Class "C"
misdemeanor and upon conviction shall be subject to the
penalties as provided by ARTICLE IV of Ordinance No.72-21, POLICE
CODE OF THE CITY OF TIGARD.
Section 4: Inasmuch as it 3s necessary for the peace, health and
safety of children, and other pedestrian persons utiliz-
ing the grounds of School District #23J within the City for recrea-
tional purposes, and to remove hazards and dangers to children and
,adultsutilizing the facilities for civic and recreational purposes,
an emergency is hereby declared to exist, and this ordinance shall
become effective upon its passage by the Council and approval by the
Mayor.
