ORDI-tANCE No-72-39
AN ORDINANCE DECLARING THE RESULTS OF THE ELECTION OF MAY 23,
1972 WHEREAT THERE WAS SUBMITTED TO THE LEGAL VOTERS OF THE CITY
CERTAIN AMENDMENTS TO THE CHARTER OF THE CITY OF TIGARD AS REFERRED
TO THE PEOPLE BY THE CITY COUNCIL PURSUANT TO THE PROVISIONS OF
ORDINANCE No.72-16 ADOPTED BY THE COUNCIL ON MARCH 13, 1972; DIRECT•-
11NIG THE CITY RECORDER TO MAINTAIN THE RESULTS THEREOF S A MATTER OF
RECORD IN T!IE PROrFRDINGS OF THE COUNCIL, AND FIXING EFFECTIVE DATE.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: The Council finds that pursuant to Ordinance No.72-16
duly adopted by the Council on March 13, 1972, there was
referred to the voters of the City at the statewide primary election
of May 2 , 1972 in the precincts within the City, four proposals to
amend the Charter of the City, all as set forth in said Ordinance
No. 72-16, which by reference herein is made a part hereof.
Section 2: The Council finds that all of said proposals were included
ia: the election proceedings conducted by the Department of Records
and Elections of Washington County, Oregon and that the Director of
Elections has heretofore certified the results to the City, and the
Council is now prepared to declare said results as hereinafter set
forth.
Section 3: That with respect to amendment of Sections 7 and 8 of
Chapter III of the Charter, as set forth in Sections 1
and 2 of Ordinance No.72^16, the reuults of the elect1.an are hereby
recorded as follows:
Votes cast in favor - 1149
Votes cast against - ;22
It is, therefore, declared that by a majority of the ballots
castsaid measure was duly adopted and it is hereby recorded that
Sections 7 and 3 , of Chapter III of the Charter arc amended accord•-
ingly, and Section 9 of Chapter III is hereby repealed.
Section 4: That with respect to amendment of Section 13 of Chapter IV
of the Charter, as set forth in Section 5 of Ordinance
No. 72-16, the results of the election are hereby recorded as follows:
Votes cast in favor - 1086
Votes cast against - 470
It is, therefore, declared that by a majority of the ballots
cast, said measure was duly adopted, and it is hereby recorded that
Section 13 of Chapter TV of the Charter is amended accordingly.
Section 5: That with respect to amendment of Section ?1 of Chapter
VI of the Charter, as set forth in Section 7 of Ordinance
No. 72-16, the results of the election are hereby recorded as follows:
Votes cast in favor - 117.1
votes cast against - 356

It is, therefore, declared that by a majority of the ballots
cast, said measure was duly adopted, and it is hereby recorded that
Section 31 of Chapter VI of the Charter is amended accordingly.
Section 6: That with respect to amendment of Section 40 of Chapter IX
of the Charter, as set forth in Section 9 of Ordinance
., No. 72-16, the results of -the election are hereby recorded as follows:
_ Votes cast in favor - 1116
Votes cast against - 421
It is, therefore, declared that by a ma-Jority of the Ballots
cast, said measure was duly adopted, and it is hereby recorded that
Section 40 of Chapter IY, of the Charter is amended accordingly.
Snetion 7: The City Recorder be, and she is hereby, authorized and
directed to cause to have a continuing record of the
amendments adopted as above, maintained in the proceedings of this
Council; and the Recorder be, and she is hereby, further authorized
and directed to annotate the official record copies of the Charter of
the City of Tigard to reflect the amendments hereinabove referenced.
Section 3: This ordinance shall be effective on and after the 31st
day after its passage by the Council and approval by
the Mayor.
PASSED: By, unanimous vote of all Council members present, after
being read three times by number and title only,
this 26th day of May, 1972.
