ORDINANCE No.72-
AN ORDINANCE AMENDING Section 10(b) of Ordinance No.62-5,
GRANTING TO PORTLAND GENERAL ELECTRIC COb1PANY A FRANCHISE TO OPERATE
AN ELECTRIC LIGHT AND POWER SYSTEM WITHIN THE CITY OF TIGARD, BY PRO-
VIDING AN INCREASE FROM 3% to 3-1/2% OF GROSS REVENUES DERIVED FROM
THE .SALE OF ELECTRICAL ENERGY EFFECTIVE APRIL 1, 1972, AND DECLARING
AN EMERGENCY.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: That Section 10(b) of Ordinance No.62-5 adopted by the
City Council on February 12, !962, granting to Portland
General Electric Company, an Oregon corporation, certain rights and
privileges, be, and the same is, hereby amended to read as follows:
"(b) As compensation for the rights and privileges
herein granted, in addition to any other consideration
In this ordinance expressed, the Company shall pay to
the City an amount equal to three and one-half per
cent (3-1/2p) of the gross revenue each year beginning
April 1, 1972, from electric energy consumed by the
Company's users within the City. Gross revenue shall
be deemed to include all revenue earned within the City
for the sale of electric energy, decreased by the per-
centage or write-off rate adopted by the Company for
the State of Oregon during said operating period for
uncollectible accounts, and excluding all sales of
electric energy by the Company to any public utility
within the City when the public utility purchasing such
electric energy is not the ultimate consumer, and
excluding sales through purely industrial: meters for
acco,Int•s having anominal demand of 3000 kw or greater.
A public utility shall be construed to include any
individual, partnership, cooperative, or other corpor-
ation or governmental agency purchasing such electric
energy and distributing same to its customers or other
users."
Section 2: That the acceptance of this amendment to Ordinance #62=5
and the agreement of Portland General Electric Company
to be bound hereby is hereto attached and by this reference made a
part hereof to the same force and effect as if set forth herein in full.
Section 3: Inasmuch as it is necessary for the peace, health and
safety of the people of the City of Tigard that the sources
and rates of revenue from public utilities within the City be main-
tained on a current basis, an emergency is hereby declared to exist,
and this ordinance shall be effective upon itz passage by the Council
and approval of the Mayor.
