ORDINANCE No.72•-
AN ORDINANCE AMENDING Section 12-(1) and (2) of Ordinance
No. 62-7 - GRANTING TO NORTHWEST NATURAL GAS COMPANY A FRANCHISE TO
OPERATE A GAS UTILITY SYSTEM WITHIN THE CITY OF TIGARD - BY PROVID-
ING AN INCREASE FROM 2% to 3% OF GROSS REVENUES DERIVED FROM THE SALE
OF GAS EFFECTIVE_APRIL 1, 1.972, AND DECLARING AN EMERGENCY.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: That Section 12-(1) of Ordinance No. 62-7 adopted by the
City Council on March 5, 1962, granting to Northwest
Natural Gas Company certain rights and privileges, be, and the sante
is, hereby amended to read as follows:
"Section 12. Compensation.
11(1) As compensation for the franchise granted by
this ordinance, the Grantee shall pay to the City an
amount equal to three per cent (3N) of the gross revenue
collected by the Grantee from its customers for gas con-
sumed within the City. Gross revenue shall be computed
by deducting from the total billings of the Grantee the
total net writeoff of uncollectible accounts and exclud-
ing sales of gas at wholesale by the Grantee to any
public utility or public agency where the public utility
or public agency purchasing such gas it not the ultimate
consumer, and by deducting revenues derived from the sale
of such gas under a tariff schedule applying to gas
supplied for industrial purposes. "
Section 2: That Section 12-(2) of Ordinance No.62-7 adopted by the
City Council on March 5, 1962, granting to Northwest
Natural Gas Company certain rights and privileges, be, and the same
is, hereby amended to reaa as follows:
"Section 12. Compensation.
11(2) The compensation required by this section
shall accrue from and after April 1, 1972 and shall be
due for each calendar half year, or fraction thereof,
within sixty (60) days after the close of such calendar
half year or fraction thereof. Within sixty (60) days
after the termination of this franchise, compensation
shall be paid for the period elapsing since the close of
the last calendar half year for which compensation has
been paid."
Section 3: That the acceptance of this amendment ,to Ordinance #62-7
and the agreement of Northwest Natural Gas Company to be
bound thereby is hereto attached and by this reference made a part
hereof to the sauce force and effect as iY set forth herein in full.
Section 44: Inasmuch as it is necessary for the peace, health and
safety of the people of the City of Tigard that the

sources and rates of revenue from public utilities within the Cite
be maintained on a current basis, an emergency is hereby declared
to exist, and this ordinance shall be effective upon its passage
by the Council, and approval of the Mayor.
