AN ORDINANCE RATIFYING, CONFIRMING AND RECORDING CHANGE
IN THE BOUNDARIES OF THE CITY OF TIGARD BY THE BOUNDARY COMKISSiON,
ORDER No. INVOLVING LANDS OF Oregon Education Association
in Section 36, Township 1 South, Range 1 West, Willamette Meridian,
WASHIITGTON COUNTY, OREGON, RECORDING EFFECTIVE TATE, AND DECLARING
EMERGENCY
WHEREAS, the Boundary Commission established pursuant to
Chapter 494 Oregon Laws of 1969 for the Portland Metropolitan Area,
by its final order dateda 72 approved the
hereinafter described change in ti. boundaries of the City Of
Tigard, and a copy of said final order has been filed with the
City Recorder,
NOW THEREFORE,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: That the final order of the Boundary Commission
adopted on the 19th day of ;ami; ,x 1972
a copy whereof is hereto attached and by this reference made a
part hereof, be, and the same is, hereby ratified, confirmed and
adopted by reference to the same legal forces and effect as if
set forth herein in full.
Section 2: That the boundaries of the City of Tigard be, and they
are hereby, changed to include the lands as described
in the within order of the Boundary Commission, and the corporate
limits of the City of Tigard are hereby changed in conformity
therewith.
Section 3: That the Recorder of the City of Tigard be, and she
is hereby, directed to forthwith file a copy of this
ordinance, including a copy of said Order, in the following
bfficesa
(a) Secretary of State
(b) r—mlartment of Revenue and Taxation, Washington County
(c) Department of Records and Elections, Washington County
(d) Department of public Works. Attention: Surveyor,
Washington County
Section 41 That the City Manning COV=ission be. and it is hereby,
authorized and directed to conduct such proceedings as
may be necessary to conform the authorized zoning and land use of
the described premises to the requirements of the City's Zoning
Map and Code.
Section 5: Inasmuch as it is necessary for the peace, health and
safety of the people of the City of Tigard that the
foregoing change in the boundaries of the City become a permanent
part of the City's records, an emergency is hereby declared to
exist, and this ordinance shall be effective upon its passage by
the Council, and approval by the Mayor.

RE: BOUNDARY CHANGE PROPOSAL NO. 356 - Annexation of the follow-
ing territory to the City of Tigard
Legal Description
That portion of land in section 35, Township 1 South, Range 1
West, Willamette Meridian, Washington County, Oxegon, being more
particularly described as follows:
Beginning at the Northeast corner of Lot 11 of Fruitland Acres,
a subdivision of record in said County; thence West, along the .
North boundary line of said Lot 11, a distance of 250.0 feet to
the Northwest corner of that tract of land conveyed to Oregon
Education Association, Book 553, Page 715, Deed Records of said
County; said Northwest corner of the Oregon Education Association `
tract of land being the true point of beginning of this description;
thence running blest, along the North boundary line of Lot 11 and
along a Westerly extension thereof, a distance of 349.28 feet to
..a point on the centerline of 40 foot wide County Road No. 245
- (S.W. 72nd Avenue) ; thence South, along the centerline of County
Road No. 245, a distance of 145.38 feet to a point of intersection
with a Westerly extension of the South boundary line of Lot 12 of
Fruitland Acres; thence East, along the said extension and South .
boundary line of Lot 12, a distance of 350.08 feet -to the South-
west corner of that tract of land conveyed to George F. Paulsen,
Book 421, Mage 231, Deed Records of said County; thence Northerly,
along -the West boundary line of the Paulsen tract and along the
West boundary line of the Oregon L";dWL:C]4Svtl Kssvc1C'LLd.VIl tract, a .
distance of 145.38 feet to the true point of beginning of this
description. Containing approximately 1. 17 acres,
Proceedings on Proposal No. 355 commenced upon receipt by the
Boundary Commission of a resolution from the City Council on
November 4, 1971 requesting that the property described above be
annexed to the City. The resolution meets the requirements for
initiating a proposal set forth in ORS 199.490, particularly
Section 2 and paragraph (a) of Section (1) .
Upon receipt of the resolution the Boundary Commission published
and posted notice of the public hearing in accordance with ORS 199.520
and conducted a public hearing on the proposal on December 1, 1971.
The Commission also caused a study to be made on this proposal which
considered economic, demographic and sociological trends and pro-
jections and physical development of the land.

On the basis of tide public hearing and the study, the Boundary
Commission made a number of findings:
s
a) the territory to be annexed is contiguous to the City;
b) the territory contains one acre, one single family
dwelling, and an estimated population of 3 persons;
c) the City proposed this boundary 'change as part of a
total program to annex its fringe area because the
City's irregular boundaries are hampering the orderly
t and efficient -administration of certain public services
in the area--specifically police protection, local. street
construction and maintenance and land use planning and
control;
d) the City has recently completed a comprehensive land use
planning program and the Council has adopted the "Tigard
Community flan" which includes the property in this boundary
change proposal;
g e) the territory is within the service sphere of the City
for sanitary sewerage service and police protection.
at On the basis of the findings listed above, the Boundary Commission
approved BOUNDARY CHANGE. PROPOSAL NO. 356 on January 19, 1972.
NOW THEREFORE IT IS ORDERED THAT the territory described above
be annexed to the City of Tigard as of 45 days from this date or
at what other subsequent date that the law requires
