AN ORDINANCE RATIFYING, CONFIRMING AND RECORDING CHANGE
IN THE BOUNDARIES OF THE CITY OF TIGARD BY THE BOUNDARY COMMISSION,
ORDER No. 355 , INVOLVING LANDS OF Vernon L. Trigg & Bernice B.
Trigg in Section 4, Township 2 South, Range 1 West, W.M.,
WASHINGTON COUNTY, OREGON, RECORDING EFFECTIVE DATE, AND DECLARING
AN EMERGENCY
WHEREAS, the Boundary Commission established pursuant to
Chapter 494 Oregon Laws of 1969 for the Portland Metropolitan Area,
by its final order dated Januar 19, 1972 approved the

hereinafter described change n t boundaries ndaries of the City of
Tigard, and a copy of said final order has been filed with the
City Recorder,
NOW THEREFORE,
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: That the final order of the Boundary Commission
adopted on the 19th day of January, 1972
a cop; whereof is hereto attached and by this reference mads a
part hereof, be, and the same is, hereby ratified, confirmed and
adopted by reference to the same legal force and effect as if
set forth herein in full.
Section 2z That the boundaries of the City of Tigard be, and they
are hereby. changed to include the lands as described
in the within order of the Boundary Cor=ission, and the corporate
limits of the City of Tigard are hereby change4 in
therewith.
Section 3s That the Recorder of the City of Tigard be, and she
is hereby, directed to forthwith file a copy of this
ordinance, including a copy of said order, in the following
offices:
(ai) Secretary of State
(b) Department of Revenue and Taxation, Washington County
(c) Department. of Records and Elections, Washington County
(d) Department of Public Works, Attention: Surveyor,
Washington county
Section 4s That the City Planning Commission be, and it is hereby,
authorized and directed to conduct such proceedings as
may be necessary to conform the authorized zoning and land use of
the described ,premises to the requirements of the City's Zoning
Map and Code.
Section 5: inasmuch as it is necessary for the peace, health and
safety of the people of the City of Tigard that the
foregoing change in the boundaries of the City become a permanent
f part of the City's records, an emergency is hereby declared to
exist,: and this ordinance shall be effective upon its passage by
the Council, and approval by the Mayor.

RE; BOUNDARY CHANGE PROPOSAL NO. 35S - Annexation of the follow-
ing territory to the City of Tigard
Legal Description
That portion of land in Section 4, Township 2 South, Range I
Test, Willamette Meridian, Washington County, Oregon, being
-more particularly described as follows:
Beginning at the Northeast corner of said Section 4; thence
South 01 421 20" West, along th East boundary line of Section "
4, a distance of 1566.53 feet to the Southeast corner of Tract
"?3" of Bellwood, , subdivision of record in said County; said
Southeast corner of Tract "B" of Bellwood being the true point
of beginning of this description; thence running North .870 26" 00"
West, along the south boundary line of Tract "B" of Bellwood, a
distance of 466.87 feet to the most Northerly corner of Lot 10
of Bellwood; said most Northerly corner of Lot 10 being a point
on the East boundary line of. said subdivision; thence South 010
261 40" West, along the East boundary line of Bellwood, a distance
of 446..90 feet to the most Soi..itherly Southeast corner of
Bellwood: thence North 870 231 301" gest:, along the most Southerly

point of beginning of this description. Containing approximately
5.04 acres.
Proceedings on Proposal No. 355 commenced upon receipt by the
Boundary Commission of a resolution from the City Council on
November 4, 1971 requesting that the property described above be
annexed to the City. The resolution meets the requirements for
initiating a proposal set forth in ORS 199.490, particularly
Section 2 and paragraph (a) of Section Cl) .
Upon receipt of -the resolution the Boundary Commission published
and posted notice of the public hearing in accordance with ORS 199.520
and conducted a public hearing on the proposal on December 1, 1971.
The Commission also caused a study to be made on this proposal which
considered economic, demographic and sociological trends and pro-
jections and physical development of the land.

On the basis of the public hearing and the study, the Boundary
Commission made a number of findings:
a) the territory to be annexed is contiguous to the City;
b) the territory contains 5 acres, 1 sir_gle family dwelling,
and an estimated population of 3 persons;
c) the City proposed this boundary change as part of a total
program to annex its fringe area because the City's
irregular boundaries are hampering the orderly and
efficient administration of certain public services in
the area--specifically police protection, local street
construction and maintenance and land use planning and
control;
d) the City has recently completed a comprehensive land use
planning program and the Council has adopted. the "Tigard
Community Plan" which includes the property in this boundary
change proposal;
e) the territory is within the service sphere of the City

for sanitary sewerage service and police protection.
On the basis of the findings listed above, the Boundary Commission
approved BOUNDARY CHANGE PROPOSAL NO. 355 on January 19, 1972.
NOW THEREFORE IT IS ORDERED THAT the territory described above be

annexed to the City of Tigard as of 45 days from this date or at
-wrhat other subsequent date that the law requires.
