ORDINANCE No.72- 6
i AN ORDINANCE AUTHORIZING THE MAYOR AND RECORDER TO EXECUTE
ON BEHALF OF THE CITY OF TIGARD A COOPERATIVE AGREEMENT FOR THE PURPOSE
OF CONDUCTING A CONTROLLED AERIAL RECONNAISSANCE FEASIBILITY STUDY WITH
RESPECT TO THE INTERSECTION OF PACIFIC HIGHWAY WEST-GAARDE STREET;
FIXING AN EFFECTIVE DATE AND DECLARING AN FMrRGENCY.
WHEREAS, the City Council finds that it is necessary and in
the public interest that an aerial reconnaissance feasibility study
be: conducted with respect to certain proposed routes in the Pacific
Highway Wast-Gaarde Street intersectior area, to be conducted in
cooperation with the State of Oregon through its Highway Commission
and Washington County, and the Council further finds that it is in
the best interests of the City that said aerial survey and study be
conducted by the State and that it is equitable that the total cost
thereof estimated at $1800. be shared equally by the State, County and
City, NOW, THEREFORE,
THECITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: That the Mayor and Recorder of the. City of Tigard be, and
they are hereby, authorized and directed to exeL,k on
behalf of the City a cooperative agreement in the form hereto attached
marked Exhibit "A" and by this reference made a. part hereof, and the
City is hereby committed and bound to the terms and provisions thereof.
Seetion 2: Inasmuch as it is necessary for the peace, health and
safety of the people of the City of Tigard that all rea-
sonable efforts be directed toward the improvement of the Pacific
EIghway`West-Gaarde Street intersection to accomplish the same with
the least possible delay, an emergency is hereby declared to exist,
and this 'ordinance shall become effective upon its passage by the
Council and approval by the Mayor.

Gentlemen:
j In compliance with a request from the Tigard City Council, the
Oregon State High'aay Commission, Washington County and the City of
Tigard propose to enter into a cooperative agreement for the purpose of
conducting a controlled flight aerial reconnaissance study to determine
the feasibility of certain proposed routes in the area adjacent to the
Pacific Highway test-Gaarde Street intersection. Attached hereto, marked
Exhibit A, and by this reference made a part hereof, is a sketch map
showing the approximate location of the area to be studied.
State, County and City hereby pledge complete cooperation, each
with the other, in 'order to accomplish effectively those things set forth
and agreed to in this agreement.
The State shall conduct a controlled aerial survey and prepare
an estimate of cost for realignment of Gaarde Street in such a manner
as to intersect Pacific Highway West opposite McDonald Street. Said
estimate shall also include the cost of relocation or extension of the --
frontage road lying westerly of Pacific Highway West.
The State, County and City agree to participate equally in the
total estimated cost of $1,800. Ilashington County and the City of Tigard
shall each deposit with State their check or warrant in the amount of
$600 upon execution of this agreement. Upon completion of the study and
receipt from State of an itemized statement of the final total actual cost,
County and City shall either pay to State a sum of money which; when added
to said deposit, shall equal their portion of the final total cost of the
study, *or shall be refunded all that portion of said deposit which is in
excess of the final total cost of said study.

The City shall adopt an ordinance authorizing the Mayor and
Recorder to enter into this agreement, and the same shall be attached
hereto and made a part hereof.
IN WITNESS WHEREOF, the parties hereto have set their hands and
affixed their seals as of the day and year hereinafter written. City
has acted in this matter pursuant to Ordinance No. adopted
by its City Council on the day of 1972.
This agreement was approved by the Oregon State Highway Commission
on 1972, at which time the Secretary for the
Commission was authorized and directed to sign said agreement for and on
behalf of the ;.:ommission. Said authority is set forth .n Volume ,
