by its final order dated Jul 28 1971 approved the

Section Is That the final order of the Boundary Commission
adopted on the 28th day of Julv. 197

ti adopted by reference to the same legal force and affect an if
set forth herein in full.
Section 2: That the boundaries of the: City of Tigard ice, end they
are hereby, changed to include the lands as described
i in the within order of the Boundary Ao=mission, and the corporate
limits of thea City of Tigard are hereby changed in w,eiorr- ity
therewith.

is hereby, directed to forthwith file a copy of this

Section 4F That the City Planning Ccmaission be, and it is hereby,
i authorized and directed to conduct such proceedings as
may ke necessary to conform the authorized zoning and land use of
the described premises to the requirements of the City's Zoning
map and Code.
Section 5: Inasmuch An it is necessary for the peace, health and
safety of the people of the city of Tigard that the
foregoingchange in the boundaries of the City become a permanent
part'off the City's records, an emergency is hereby declared to
exist, and this ordinance shall be effective upon its passage by

WHEREAS, on June 17, 1971 , the Commission received a petition from
propertyowners requesting that the property described above be
annexed to the City;
WHEREAS, the petition meets the requirements for initiating boundary
change proposals in ORS 222.170 and paragraph (a) , Section (1) of
f ORS 199.495 ;
WHEREAS the Commission duly published notice of public hearing in
. Y
accordance with ORS 199. 520 and conducted a public hearing on
j July 28 , 1971, in -accordan.ce with the rules of the Commission and
paragraph (b) , Section (1) of ORS 199.475;

WHEREAS, the Commission caused a study to be made of this proposal
as provided in paragraph (a) , Section (1) of ORS 199.475;
WHEREAS, on the basis of the study which considered economic, demo- `
f graphic, and sociological trends and physical development of the
land, and the public hearing, the. Commission found that:
a) the territory to be annexed is contiguous to the City;
b) the territory contains 1. 5 acres and is undeveloped;-
c) a portion of the property owner's property is already in
the City and he is requesting that the remaining portion
(the territory to be annexed) be included in the City so
it may be developed under a single set of land use regula-
tions and building codes; and
d) the boundary change is a logical extension of the City of
Tigard.
WHEREAS, on t}.e basis of the findings the Commission approved
BOUNDARY CHANCE PROPOSAL NO. 313 on July 28, 1971;

NOW THEREFORE IT IS ORDERED THAT the territory described above be
annexed to the City of Tigard as of this date.
