ORDINANCE No-71-
AN ORDINANCE VACATING DEDICATED UNOPENED PORTION OF S.W.PARK
STRL1.T IN THE CITY OF TIGARD= IffffliINGILOIL COUNTY, OREGON.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: The Council finds that a resolution was adopted by the
v Council on May 24, 1971, pursuant to 5271.130 ORS,whereby
the Council initiated vacation proceedings with respect to the herein-
after described dedicated unopened portion of a public way and that
a public hearing was thereby called to be held on June 23, 1971 and
that notice of said hearing was given as required by §271.110 ORS as
set- forth in said resolution.
Section 2: The Council further finds that a public heariog, as thereby
called tc be held, was duly and regularly held at the regular Council
meeting; on June 28,1971 at which time and place the Council afforded
all interested persors an opportunity to be heard for or against the
proposed vacation of said lands, and the Council further considered
all objections thereto.
Section 3: The Council further finds that a majority of the owners of
-- the area affected by said proposed vacation, computed on
the basis Oravided in §271.080 ORS, did not object thereto in writing
and that all owners affected thereby did, in fact, favor the vacation
of said area; and the Council finds that said vacating will not sub-
stantially affect the market value of any abutting; property.
Sectio_, 4: The Council further finds that the public interest- Gill not
be prejudiced by the vacation of the hereinafter described
lands and that said lands are not useful as part of the public street
or road system of the City of' Tigard and that it is in the public In
terest that said vacation be approved.
Section 5: The Council further finds that the City recording officer
has filed in her office a certificate showing that all
city_liens and taxes have been paid on the lands proposed to be vacated.
Section 6: That the following described portion of dedicated unopened
street be, and the same is hereby, vacated, and the richts
of tine public therein and thereto be, and the same are hereby, annulled
and held for naught: As described in Exhibit A attached hereto
and by reference made a part hereof.
Section 7: That the City Recorder be, and she is hereby, authorized
—" and directed to have a certified copy of this ordinance
filed for record with the following Washington County departments:
1. Department of Records and. Elections
2. Department of Revenue and Taxation - Attention: Assessor
3. Department of Public Works - Attention: County Surveyor
all as required by 9271.150 O.R.S.
Section 8-. This cdlance shall be effect on and after the 31st day

after its enactment by the City Counci;, and approval by the Mayor.

DESCRIPTION
That certain portion of the Northwest ane-quarter of the
Southeast one-quarter of Section 3, Township 2 South, Range 1
West, Willamette Meridian in the City of Tigard, County of
Washington, State of Oregon, described as .follows:
Parcel 1. Beginning at the SRutheast corner of the North
1/2 of the Northwest 1/4 of the Southeast 1/4 of Section 3,
T 2 S, R 1 W of Willam.ette Meridian running thence West 180 feet
along the line between the Eorth 1/2 and the South 1/2 of the
Northwest 1/4 of the Southeast 1/4 of Section 3 to a pipe; thence
North 30 feet to a pipe; thence East 180 feet parallel to the
South lame of the West 1/2 of the Northwest 1/4 of the Southeast
1/4 of Section 3 to a paint; thence gouth 30 feet to the place
of beginning;
Parcel II. Beginning at the Northeast corner of the
South 1/2 of the Northwest 1/4 of the Southeast 1/4 of Section. 3,
T 2 S, R 1 W of uiillamette Merid:an; ruunair> thence West 180feet
along the line between the North 1/2 and the South 1/2 of the
Northwest 1/4 of the Snutheast 1/4 of Section 3 to a pipe; thence
South 20 feet to a point; thence East 180 feet parallel to the
Southline of the North 1/2 of the Northwest 1/4 of the Southeast
1/4 of Section 3 to a point; thence North 20 feet to the place of
beginning;
Parcel III. All that area included in a 40 foot radius
circle, the center of which circle bears 5 feet North of the
Southwest corner of the above described Parcel T.
