AN ORDINANCE PRESCRIBING SUPPLEMENTAL SEWER CONNECTION CHARGES
IN ADDITION TO ALL OTHER SEWER CONNECTION CHARGES,(including supple-
mental charges) HERETOFORE'.IN EFFECT, AND ADDITIONAL TO SEWER
SERVICE CHARGES IMPOSED BY UNIFIED SEWERAGE AGENCY OF WASHINGTON
COUNTY, OREGON, WITH RESPECT TO ALL CONNECTIONS INCLUDING EXTENDED
LINES OR TRIBUTARY LINES DIRECTLY OR INDIRECTLY CONNECTED T0, OR
UTILIZED FOR SEWER CONDUIT PURPOSES, THAT CERTAIN SEWER LINE KNOWN
AS THE "CHAMBERLAIN SEWER EXTENSION" AS HERETOFORE CONSTRUCTED AND
DEPICTED ON PLAT ATTACHED HERETO (denoted Exhibit "A"), PROVIDING
FOR PAYMENT THEREOF AND DECLARING AN EMERGENCY.
THE CITY OF TIGARD ORDAINS AS FOLLOWS:
Section 1: The City Council finds that the "Chamberlain Sewer
Extension" line depicted on the plat attached hereto
and denoted Exhibit "A", by reference made a part hereof, was by
direction of the City increased from eight (8) inches) to ten (10)
inches in diameter and thereby oversized to enable the City to Pro--
vide extended service to properties now or in the future desiring
sewage disposal services through the medium of said line, and that
it is fair and equitable that the City of Tigard reimburse to the
private developers the sum of representing the
cost of oversizing the line in excess of 7 inches.
Section 2: The Council further finds that thegravity drainage area
which may feasibly be served by said extended sewer line
herein denoted "Chamberlain Sewer Extension", will be directly ben-
efitted by the said oversizing now or at such later date as further
extensions or tributary lines are constructed or connected to said
Chamberlain Sewer Extension, and that it is equitable and economic-
ally necessary that the City recover through the media of supple-
mental charges as hereinafter prescribed, the amount of the City's
loan from the Sewer Fund paid to the private developer for the
oversizing of said line at the request of the City.
Section 3: That in accordance with the foregoing findings, in addi-
tion to all other sewer connection charges heretofore
or hereafter paid to or assessed by any other political subdivision
or municinality of the State of Oregon, or by the City of Tigard, or
by the Metropolitan Service District, each lot, tract or parcel of
residential property hereafter connected directly or indirectly,
or by. tributary or extended line, to the Chamberlain Sewer
Extension as depicted on Exhibit "A", shall be assessed, and the
owner, developer or other user requesting a connection shall as a
condition precedent to said connection, pay the sum of $50.00 as and
for a supplemental sewer connection charge.
Section 4: That all charges hereby imposed shall be due and payable-
concurrent'with and shall be paid to the City of Tigard
at such time as payment of the basic sewer connection charges are due
and paid to the City of Tigard or to any other public authority.
Section-5: That :the supplemental sewer. charge hereby imposed shall
continue in full force and effect for such period as

necessary for the City to recover the total sua ^-f ;;
at the rate of $50. per connection, or for a perlod ft3t
years from the date hereof, whichever first occurs, and shall there-
uoon terminate.
Section a: That all funds derived hereunder :hall be applied in
tamortization of the City's contribution by way of loan
to the construction costs of said "Chamberlain Sewer Extension" and
shall be accounted for accordingly.
Section 7: That the City Administrator, subject to the legal approval
of the City Attorney, shall obtain on behalf of the City
full ownership of said "Chamberlain Sewer Extension" together with
all easements and grants necessary to the continued use thereof in
the name of t.ae City of Tigard and to extinguish all ownership and
proprietary interests of private parties, and upon completion of
transfer to the City, the same shall be for all intents and purposes
a part of the City's sewage collection system, subject to the terms
and provisions hereof.
Set:tion 8: Inasmuch as applications for sewer connections withinthe
purview of this Ordinance are at hand or will shortly be
received and it is necessary for the peace, health and safety of the
people of Tigard and to preserve the financial integrity of the City's
*ewer funds that provision be made for the assessment and collection
of the charges herein set forth with the least possible delay, an
emergency is hereby declared to exist and this Ordinance shall become
effective upon its passage by the Council and approval by the Mayor.
